For anyone in a similar situation this may help:-

1. Seek a Mandatory Reconsideration of the decision first then Appeal if necessary (make sure that you have the Documentary Evidence of your medical condition available).

2. Seek advice from the C.A.B. or other Advice Agency when requires or look at their website for info.

3. Phone the Benefits Enquiry Line if necessary.

Good post mate i think its nice of you to put information up to help people with their claim for ESA as lots of people seem to be having the same sort of problems. I my self am applying for ESA just waiting for forms in the post. As i have been signed of 2 weeks ago as i am no longer able to work at the moment due to having an industrial accident at work. I just hope i dont have the same trouble that people are talking about Best Wishes mate. Poohbear'

Good advice but jut to clarify,

If you intend to appeal against DWP decision you HAVE to go through mandatory reconsideration first. No going straight to appeal as old days. There is no time limit on his reconsideration either.

You also lose your benefit while waiting for this second decision. DWP are trying to deter people from appealing. But if decision overturn money is backdated.

Many CABs have closed and getting harder to find one. But yes find someone who can advice.

Lastly try and send all medical letters when you first submit your ESA 50 form.

As a ESA Support Claimant who had to go to the tribunal. My best advice is make sure that all your medical notes you have of your conditions are copied and then find what office is dealing with your case and then go to your local JSC. You will need to book an appointment and explain it is to send or fax though to the office concerned. This is proof that it has happened as they have to log it all down and they cannot say they have not received it.

This happened to me loads and I sent them all by recorded delivery at first which is expensive. I had a time I called to confirm they had the info and they claimed they did not, so when I said well it was signed for at the time by this person they suddenly found it? But once I started sending everything though the JSC they never said it again.

Another tip if you see a consultant always ask for you to be cc'd in the GP letter. They have to do it if asked and you are not charged!
