We are dual nationals British/Australians returning to Australia in May . We asked for help from Social Services as we have 18 yr old twin boys, with a rare chromosome deletion. They are aware we are returning home , the boys have been abused by respite workers in the UK & want to go home as do we , however Social workers are saying we are not meeting the boys needs , the boys are refusing to go out anywhere as they are frightened here after the abuse , they want to put both in a flat with a carer , the boys have never been away from us developmentally they are toddlers & have separation anxiety, they also want advocates to assess them under the mental capacity act , we are terrified and questioning why if we are going home but are getting no answers. Are we paranoid or should we be concerned they are trying to take our boys .

I suggest you phone the Mencap helpline and they will signpost you to specialist advice. If the boys are 18, they are adults and if they are mentally toddlers they will not have capacity to make the decision to leave the country. This means that social care have to agree that it would be in their best interests to go, which they are unlikely to do if they feel you are not meeting their needs. They have to safeguard the boys. Ultimately, it may be that the Court of Protection has to make that decision on behalf of the boys. Since you didn't get advice on removing incapacitated adults from the country before you bought your tickets, you might need to plan for your trip changing in the short term.
