had a injury at work , hit on head with skip, i have had headaches and involuntary movements and other stuff,

Went to see a neurologist that solicitor arranged for me.

First asked if was knocked unconscious i wasn't so he said my headache and neck pain weren't from being hit on head as it should have gone by now.

Every thing wrong with me was not caused by injury after been hit on head with skip, he basically said head and neck pain not caused by accident.

My involuntary movements he said show me? i said involuntary happen when they want 100-200 a day, he didn't believe me.

My problem is how do i go forward solving head and neck pain, i cant sleep with wife as involuntary movements twitch to much i don't know what to do doctors say post traumatic concussion but that doesn't cure it just a diagnosis ,

You don't have to accept this report, do not sign it if you disagree. I've been through this process, medco-legal, their job is to assess your medical records and say that everything you have experienced is psychological or made up.

Big tip, don't sign, ask your solicitor to disregard the report, they have to arrange another one. The thing to do is to make sure you have seen a full array of specialists through the NHS, this then goes into your medical records and when you get reassessed by medco-legal the information is there and they can't refute it.

So say to your solicitor that you need to get all the symptoms explored via the NHS before they make another appointment with the 'medical expert.'

thank you , i didn't know what to do ,that's helped me loads i feel i have a direction to follow , its the fact that i have these symptoms and hid did not believe me. going to contact solicitors tomorrow

As you are at the beginning of the claim you should consider what Boots suggested 'have you got the right solicitor' Headway have a list of solicitors with brain injury/head injury expertise. If your solicitor has not got this I would recommend, from experience, changing because you will end up having to fight your own solicitor to get them to represent you properly.

Lets clear up a few myths, the medical expert works for the ministry of justice and is independent of sides. Their job is not to make a diagnosis but to review the medical records but also to challenge you to see if you are making it up. So it is important to make sure all the medical evidence is in your medical records before going to see them.

Getting the medical evidence, have you had scans? If not go to your GP and get referred. Secondly have you seen a neurologist in the NHS? If not get referred. If the scan is clear you'll need a neuropsychology assessment. Also your involuntary movements may be due to damage to the nerve roots in the spine at your neck and upper spine, this too needs a scan. If your GP won't refer you, you will need to fight them also.

To do this you will need to make an official complain to the GP practice. If they still won't refer you, change GP practices. At the new practice ask if they would look at your symptoms with fresh eyes, do not mention insurance and take someone with you who knows you and can confirm the changes.

You mention getting depressed, if you tell the doctor you have been depressed since the accident they will blame your symptoms on the depression especially if you have been to see them previously for any mental health issue. Make a distinction, the symptoms from the head injury have led to changes in your life that have led to feeling depressed. Personally I would not mention any mental health issues, they will use it against you in what's called somatoform symptoms, ie you feel depressed which in turn causes tremors.

So today when you phone your solicitor ask them if they have brain injury expertise and if they don't check the list on headway and make enquiries. You don't have to tell your current solicitor.

Remember solicitors want to make maximum profit for minimal work.

Headway also have information on solicitor conduct, what to expect from your solicitor.

Make sure your solicitor is registered with the 'solicitors regulatory authority' SRA, it should say on their web page, if not ask them. If they are not change because you will have no protection or means of complaint.

Hope that helps, it's a really stressful process so strap in, you will get treated like a criminal and your whole life will get ripped to shreds, so dig in and hold your ground.

Hi Silver, who's solicitor arranged this? If it was the solicitor for you, then they need to arrange a better assessment. If it is the solicitor from the other side,he has a vested interest to minimise your injury.

It sounds like you need support from a neuro rehab team. You should be able to ask for this from the hospital that treated you, or via your GP.

It may seem quicker to get private care and assessments, but they are paid by the case, and will do the least care for the greatest sum.

Hi SF,

others have given you really great advice. Not all medical people are created equal, and not all are up on brain injuries - even when they are neurologists. Not kidding.

You may need to get diagnosed by a neuropsychiatrist - keep in mind in the medical world, hisotrically if it weren't broken, burned, or bleeding, it got lumped into psychiatry. So no, I am not trying to say it is all in your head - well, it is all in your head but not in that way - ha ha.

Neuropsychiatrists can make a brain injury diagnosis in the absence of gross physical damage and certainly something falling on your head like that would be unlikely not to cause some problems. Because they are trained in brain stuff and psychiatric stuff they are experts in telling the difference so they carry a lot of weight - at least they did in my case.

When someone isn't helpful, recognize it and move on. You will, unfortunately, meet more than a few of those. There are lawyers who are more informed about head injury than others and it would be a good idea to find one that is, if possible. Often they say so on their web sites.

Looking at old court cases can also help you find people, you might have to ask at the court house how to find out, but someone there will know.

This neurologist is likely trained somewhere very old school, and so isn't well informed enough to be of use to you. I found the best thing to say when asked why you want another referral is just to use the 'oh they weren't helpful' phrase.

Stop and reconsider whether you have been given truly well informed and independent advice ie from drs and solicitor who owe a duty of care to you and you alone. Don’t sign anything until you are sure that drs and solicitors are acting for you and in your best interests. Don’t sign anything yet, you have three years to bring a legal claim. It’s not clear from your post but it sounds awfully like you are being asked to do something which is not in your best interests. Dot
