I have been in two minds about writing how I'm feeling at the moment.
I'm facing g redundancy due to covid. However based on my performance over the last 12 months, I feel I'm being discriminated against due to taking sick days, when I have been unable to work, let alone get out of bed or walk!
Well this would not have been a pretty sight for the children in the nursery to see!
I have been loyal and worked when having being in pain.
My condition worsen in Oct of last year, and signed off end of Jan to march.
Just wondering if anybody would know where I would stand, as I'm appealing this decision.

My limited understanding is that if you have a disability, if they use attendance as a way of determining who is up for redundancy, they can't take into account any days of sick that are directly related to the disability.
So the question is does your endo count as a disability, endo isn't automatically classed as one as everyone experiences out differently, so it's very much on an individual experience. If so is your employer aware of it being a disability. Then if yes to all of those, then the final question is have they used attendance to determine who is up for redundancy (not all companies use this as a factor).
If you Google disability and redundancy you should be able to find more information on what they can and can't take into account. If you're unsure if your endo counts as a disability look into it, but if you aren't sure then your employer won't know so wouldn't be able to factor it in if they needed to.
My employers have been aware of my condition and up to be fair have been somewhat supportive. However, my biggest sickness was this year. Throughout I have worked in excruciating pain, only taking time off when physically unable to walk.

Is it only you facing redundancy ?where do you work?i was off sick for 5 months and reduced hours I’ve now been told not to come back yet and stay in furlough.but after speaking to a colleague found out we are not open on the day that I work any longer so not sure where I will stand .its hard to fight of redundancy cause you will get redundancy pay when I got made redundant the company wasn’t making money so there’s not much to fight if it’s redundancy as they can’t afford to keep you because the company is on its way out
I’m so sorry you are going through this I know it’s not nice you being made redundant but It will be done lawfully I would hope.you can appeal to it since it’s based on performance however one of you will have to leave by the looks of things which is not nice in itself. I guess you would have to explain why you should be kept on and what you can offer the business.looks like your in a similar boat to me I would not be be surprised if I got made redundant I won’t be fighting it if it happens to me as I’d like to look at it as a positive I’ve been wanting to hand my notice in a while .mine have been supportive but that’s to my face I don’t know what goes on behind closed doors I started of being supervisor but It slowly got took away from me .I got I’ll and tbh I was never treated fairly there are times they get away with stuff and sometimes fighting just takes months or years of hassle the decision will definitely be made by the manager unless you have hr review or something so being on her good side will help and arse licking but then everyone will be doing that I can tell you this cause I’ve worked in management roles and sometimes there’s more gossip than you think but I hope you keep your job and good luck x
Thank you again. They obviously have to do what's good for the business. But unfortunately, it doesn't matter how good you are you job, some companies only see the lather, not the overall picture. Nevermind onwards and upwards

The reasons are important in establishing discrimination or it’s a company no money issue.
I’m facing the same, but due to financial rather than Covid.
I’ve had HR role and have had to be part of making people redundant in the past due to business. It’s a process that has several stages and depending on reasons, doesn’t have to be accepted.
It’s not easy, but still has to be a fair process. ACAS are very good.
If everyone could do the remaining work for example, they have to create a fair criteria that they can explain the reasons. It’s no longer last in, first out.
I’ll have to write my own redundancy letter for the owner to sign 😂
I would advise giving ACAS (Advisory, Conciliation and Arbitration Service) a call. They provide a free service that includes explaining the current laws and options available to you. You can remain anonymous if you wish.

I just wanted to say that I feel your pain (physically and mentally). I have worked in a big nursery for 2 years now. I worked 3 days a week because I was also doing my diploma in counselling part time. Working long hours at a nursery has been really difficult when I have bad endo days. We are on our feet all of the time, bending down, sitting on the floor with our legs crossed, picking children up etc, running around and playing with them...it’s really hard and really physically and mentally tiring. I love it. But I’ve had to have lots of days off due to endo pain being too bad. Can’t exactly walk around with a hot water bottle superglued to our tummy and back can we? I empathise and hope that your nursery can see that the time you took off was 110% valid and needed.
