A few weeks ago I posted that I'd received a letter regarding a deputy bank account with regards mum's care. Thank you to all who replied, the underlying things that came through was that my brother, sister and myself should have been told about this.....WE'VE NEVER BEEN TOLD ABOUT THIS

My sister has just rung to say that mum's bank account has now been closed, she's been running around to try and find someone who can help/advise, CAB, Law Society and a couple of others, I forget who else are all saying no they cannot help us, although she's been pointed in the direction of someone from the council who lives local to her, although he's unable to help he has told her that now council letters don't put a person's name on them.

The council want in excess of £10,000 but they cannot,or will not provide a breakdown of costings for us, the 3 of us would struggle to get that amount of money together and obviously if we ended up overpaying the overpayment wouldn't come back to us, so my sister has suggested the house gets sold to the council and keep my brother and sister there as tenants.

Can anyone suggest what we do next?

How worrying for you all. I assume that the council wants this money to top up her care home fees? We had to sell mum's house and now all that money has gone her grandchildren are subsidising her. It is a very poor system when people have saved all their lives and get penalised when they get old.

Hi Jennymary, Thank you for coming back to let us know what's been happening, especially as the outcome so far is far from satisfactory and must be worrying for you.

Are you absolutely sure that CAB can't offer any help, even in terms of pointing you in the direction of the correct legal help? And have you actually had a consultation with a lawyer, because it's a little odd for a lawyer ever to say 'I can't help you'.

When all's said and done it remains most peculiar that you are, as her family, finding out about this now and there's something disturbingly not right about it all.

What is the £10,000 the council is demanding? If it is a contribution towards her care in a nursing home, then there may be little you can do, except that this mystery remains as to why all of this has happened when you are mum's next of kin and know nothing of all the foregoing to her bank account being closed.

Do make an appointment with a lawyer, even if one of the legal profession has directly said that he/she can't help you. Whatever goes wrong in life, there is always a legal challenge to be had.

The best way forward is with direct professional help to get to the bottom of what was and is going on with your mum's finances.

Councils like to think can do what they want BUT they can’t

Quality Care Commission deal with issues around Care and Finaces and Capacity

Clearly someone ruled you mother dose not have capacity eather social worker or home manager Quality Care Commission can find out who

The law is changing on capacity and suitable advocates GIVEN lot of home managers take mick.

I heard for issues of capacity you are intitialed to free legal aid

I would get clarifacation from quality care commmision OR social services

If all that fails I would issues safe guarding issues with local authoritie against home mothers in SO you know who what’s going on
