You're very lucky as I've been turned down and mandatory reconsideration rejected.

Mine was too so you need to through the whole appeal process. Look for form SSCS1 and complete it to start your appeal.

Mine took about a month to start paying me again and two to get the full back payment, this was after going though an ESA appeal that took six months. Keep a check of what you do expect though as my initial repayment was over £1,000 less than it should have been and when I called to ask why there was not one person that had an explanation. They expect us not to notice and be grateful for what we get it seems!

Denise LB did you get the underpayment paid out? We are waiting to be paid our backpay having just won the tribunal appeal. Many thanks

Well done by the way as I know how hard it is to go through the process. Yes but it took a few weeks and I did end up having to call them, more than once. They are allowed a month anyway to appeal if they want to. It was 7 weeks before they rectified the fortnightly payments then they had lost or misplaced my doctors certs so I had to send them copies, oh and then they insisted on keeping me on the phone while they transferred the underpayment, sadly though that was not the end for me as I still had not had my ESA assessment, my appeal was based on me being entitled to a home visit. It was another year before I got that and then another two months before I received the revised benefit, it was then that for no reason they held back just over £1,000.00.
