Disaplinary through illness anyone?

Only joined yesterday and what a great response I have had. Another question...Does anyone have work issues due to their illness? I'm on my final written warning due to attendance, don't know how they can be so cruel when we are going through enough ourselves, I have a fit note on every occasion but this is not good enough

If your not in a union join one . If you are seek advice asap . Contact your occupational health and get them involved. You shouldn't be getting reprimanded you should be supported by employers if they know you have a medical condition that affects your health. Also speak to ACAS xx

Your employer should be taking your illness into consideration and be making allowances.

Your company has to take your fit as proof other wise they are breaking the law. Have a word with your doc and get them to give you a written letter confirming your illness. I had the same problem but as soon as I started to stand my ground they started to back off. I got proof from my specialist to back me up. Some company's do not like the fact that they have to pay you ssp for 28 weeks and try to get you to quit. What type of company do you work for. ..?

Retail Morrisons in fact! I have named and shamed them. I have done that, joined unions, called head office, spoke to acas, but cos there is an attendance policy I have failed to meet my percentage and will be dismissed!

Your union should be able to help. Ask about the Disability Discrimination Act. Why not try the BLF helpline for further advice? 03000 030 555 during office hours.

Hi as long as your employers are aware of your illness or should reasonably be aware they have a duty towards you under the Health and Safety at Work Act. They have to provide what are called Reasonable Adjustments to help you stay at work. These could include extra breaks, extra sick leave, or even moving you to a new job. However be aware RA's are always subject to Business Needs. You should also have been referred to Occupational Health for their input but the employer doesn't have to follow any of their recommendations. As long as they make some RA's they have followed the law.

I worked for the Civil Service a few years ago now and all this happened to me too. It is unfortunately a myth to say that employers cannot sack you for illness. They can and do but they call it not fulfilling your employent contract to be at work!

Oh yes illness certainly has interfered w/my ability to make a living. So now I’m deemed permanently disabled and the government gives me a little survival money an I work a little here and there for a little extra food money.

im a ex shop stewerd so if they have not sent you for a med cq they have to by law except your dos note cus no other medical evidence is available as for frustration of contrct well if you have sickness in there you are fullfilling your contract they sound like a company that do not know the law and just boj it

I dont know the answer to this. You need to write to them explaining that under the meaning of the disability discrimination act you would be classed as disabled.

They need to make reasonable adjustments to the work place to accommodate your disability
