How disgusting xx

Hi how awful. Make sure you appeal and get lots of evidence from doctors/consultants etc. I have heard around 60% of appeals win. If you need to get help from the CAB or a local disability helpline. x

Same as my youngest son he went from getting it to zero and 0 all the way down

Disgusting but please do not give up appeal as many times as you need to and if necessary take it to court I know of several that have done that and won

MANDATORY RECONSIDERATION.

Firstly, not getting PIP first time round is upsetting and can be a setback, but it is not a situation that cannot be remedied, it must be seen as an unwelcome delay and not the end of the process.

Secondly, and probably more importantly, is how PIP and the way it works are understood.

More importantly, because you must know what they are looking for and how you can best get this across.

This forum, although supportive and with a vast resource on lung problems and everything that goes with them, is NOT a good place for advice on Benefits....not because you will not get advice and sympathy here, you undoubtedly will, but not often the right advice and ill informed suggestions on how to go about getting the result you need.

This may seem like an attack on those freely giving their time and advice, it is not. It is intended so that even people who do not get or need PIP ( or even ESA) wil have a better understanding of how to support those who do come here for help.

Let me explain what I mean:

PIP is a benefit that is awarded according to how your condition affects you in terms of mobility and your day to day living. Your part when applying is to explain this and support what you say if possible by documentation.

If this first part is not understood and you do not go about the application in the right way then the application will almost probably fail.

So, the application has failed, what do I do now?

THIS..is where ill informed advice, no matter how well meaning can make the situation much worse for the applicant.

Look back at every post where someone has come here for help with failed benefit applications, you will see three things in almost every response........Three things that are at best misleading, at worst downright dangerous to those seeking help.

The three things are:

ONE.

PIP application failures are: " Disgusting" "evil" "wicked" etc etc.............Wrong. The failure is most often because the applicant was prepared or advised.

TWO.

A very common response is to immediately "appeal"

THREE.

Or to take the matter to "a tribunal"

These three are far from helpful. Firstly PIP is not an adversary, it is not wicked or evil, any more than a pub quiz or a driving test. It is not useful to put the person seeking help in an even more negative frame of mind,

Second and Third, an appeal is for later in the process, a tribunal is where the decision is challenged on a point of law, neither of these are of any use to anyone seeking help with a failed first application. They are of no use here.

IF a PIP ( or ESA) application fails, then what you do to challenge it is to ask for a........................................................................................................................................................................

MANDATORY RECONSIDERATION

You have one month to do this, by phone or letter...........If this fails then you appeal, if appeals fail you may ask for a tribunal hearing.BUT

These will all take more preparation, research and diligence than the initial application.
