Past test results

Hi,

I have just requested my previous test results from the GP surgery, and the secretary said she would have to run in past the GP and there would be a £10 access charge. I read on here they were no longer allowed to charge, however is it different in Scotland does anyone know? I can’t find anything on the NHS site. Thanks

Unless Scotland has somehow managed to leave the EU and we haven't heard about it, then The General Data Protection Regulations and the Data Protection Act 2018 applies:

bma.org.uk/advice/employmen...

.........

Since 25 May, in most cases, patients must be given access to their medical records as a Subject Access Request (SAR) free of charge, including when a patient authorises access by a third party such as a solicitor.

..........

also

pulsetoday.co.uk/home/finan...

New European legislation will ban GPs from charging for providing personal data, in a move that could cost practices into the tens of thousands a year.

The European General Data Protection Regulation (GDPR), which comes into force next May, scraps the fees that data providers can charge people for their information.

Thanks for your quick reply. I’m thinking she must have known that she was not allowed to charge me... also we always have to pay in cash for anything, hmm.

I would threaten to report hem to the Office of the Information Commissioner for ignoring Data Protection Regulations and GDPR.

Doctors used to be able to charge £10, but this hasn't been true since 25 May 2018

Thank you for the quick reply. She must know that she can’t charge me, surely?

Yes, if you can have electronic access to blood test results, this goes back quite far

Unfortunately many GP surgeries still dragging their heels on getting this set up

Doctors don't like empowered patients

Our Thyroid UK parent website has this to say on the subject (updated just a few days ago): thyroiduk.org.uk/tuk/NHS_In...

Thank you for replying. Hmm, so if I’m reading that right, then she can charge me after all, if I want a copy? Does ‘updated in the last 40 days’ cover being added to, ie with my latest test results do you know?

EU law is you are entitled to all your medical records FREE of charge since las5 May.. so you do not have to pay.. for them charging I would make them ge5 me the whole of my medical records and make them work even harder lol x

Yes we have ‘Patient Access’, but only for repeat scripts and appointments. Good point as it was for a few years, (albeit I didn’t go very often) so like a paper charge? Haha!

I love the look of spitting feathers don't you?
