Working with CBD

Morning .

My husband is now 3 year in too his CBD diagnosis, his symptoms start two years before that . He has managed to carry on working ,but over the last 6 month he had been finding it hard ,he is suffering from back and leg pain so when he come home he just sleep ,but we both discussed that carrying on working will be good for his mental health and he loves structure ,plus got to think off the financial side ,he gets lower PIP and we have a few saving .

He approached work too see if he could reduce his hours , he had a phone consultation with occupational health ,the report come back to say he was fit for work ,but ask management to consider his request to go part time hours ,as his likely to benefit his health and wellbeing.

His work have come back with a no as it is a full time position ,he asked as his health deteriorates would they reconsider they said they might reconsidered but again they said it full time .

He wants to carry on working ,as long as his body will let him .

He as worked there for 39 years .

Any advice would be heartily appreciate.

Hi I'm not sure of your location but if you're in the UK I believe your husband has a very strong case for going part time and should push further for this. Under employment laws and good practice employers shoukd consider disability and illnesses and it seems your husbands haven't really considered the true nature of CBD and the impact and future changes. I would speak with the PSPA helpline and possibly a call to Beacon who may be abke to offer some helpful advice

I guess it is also dependent on the job he actually does, if it is a full time role then the employer may have the right to state it isn’t a role that can be done part time as there is a business need.

Did they give him the reasons why they can’t accept his application for part time working?

I would also question the Occupational therapists review as to if they understood the illness well enough to pass judgement? Also OT is an advisory service for an employer doesn’t mean the employer has to do it.

Unfortunately loyalty doesn’t seem to mean the same thing it used too.

Maybe a conversation with citizens advice in the first place?

Agree with other comments. CBD definitely counts as a disability under the Equality Act so his employer must make reasonable adjustments. Have they actually recorded him officially as having a disability as opposed to just being ill? If they say working part time is not something that the business can accommodate then they have to offer alternatives. Can he work from home? Could he have more scheduled breaks in the day? Ya it is recorded as CBD .

He has had nothing ,just a no on a piece off paper .
