hi everybody, you will never guess now what my ex-husband is saying, well I’ll tell you he is saying he has never lived in England?

Solicitor is doing his best, but because everything is in a trust in the Isle of Man, he is trying to get information but it seems as if I might lose my home.

3 1/2 years nearly 4 and I’m still being abused, by him and by authority.

I am tired, of trying to think of who else, what else I can do to prove that we have lived in England and Tenerife?

He used to say to me, Elizabeth, I always win.

Please pray for me, that this time he does not win.

Bleak times ahead for me.

Hello - I find that if you rest your mind after taking pregabalin you can often get an extremely good night's rest - breathing exercises also help but it must be practiced - I wish you well and repeat often if possible - best x

Oh Liz, my heart aches for you, still in this state of torment after so many years. You SO deserve some peace and freedom from this monstrous situation.

Unless he's made extremely thorough, clever moves to remove traces of his time in England there will be surely be evidence of your ex-husband living here. Did he have bank accounts, mortgage, or an NHS number for example.

Not knowing his history (geographically) it's hard to grasp much of the issues involved, and his strategies, lies etc. But your solicitor should know how to find traces of your ex husband's presence in England .......unless there are complications I'm not aware of.

With a magic wand I could scoop you and Shelly up and deposit you in a safe, warm home with no more hassle or money worries ; it's what you deserve ........

GP records, local authorities where council tax was paid, electoral roll census records, DVLA. HMRC. These could be used to check.Good luck

hi thanks for your reply. GP records not allowed because of the data protection act, council tax not allowed either because of data protection,,Electrol roll again they protection. everything is Data protection.

I have bank statements, your name it I have given it to the solicitor, my friend David called yesterday and he said ask your solicitor to contact your neighbours with an affidavit so that’s what I’m doing today. they all did not like him, but they have been to our home for parties. So let’s see where that leaves me. it was a bad day yesterday I left him on the 17th of December 2020 after his final beating and I have lost my voice. It is called foreign accent syndrome. Today I have another purpose to speak to my neighbours and ask them for my solicitor to contact them to give an affidavit. Many thanks for taking the time to reply love Liz🙏⭐️

a good solicitor should be able to apply for and access records for you

People astound me, they can be so horrible, try CAB they have solicitors you can ask. You must have an old photo or utilities bill lurking in the back of a drawer, or any correspondence addressed to you in your UK property. I don't know how long ago it was but do you have bank statements? Hoping you get things sorted to go your way. Take care and try not to stress.

Hi, yes, I have bank statements. everything you say I have done that. Doesn’t seem to be enough. My friend David called yesterday. He is like an odd job man done a lot of work for both my ex-husband and myself. He has suggested I contact my solicitor and asked my neighbours if they are prepared to give an affidavit to prove he has lived in our home. that is my next step. I am out today giving letters asking permission. For my solicitor to contact them. Surely that might prove that he is lying. thank you so much. I’ll let you know what happens love Liz.🙏⭐️

Are your bank statements for a joint account? Will neighbours saying he has been there be enough? As Cat3 & Moo196 say GP would have to be registered as either resident or temporary patient, with an address. As for solicitors, I have lost faith in some as a family member has been blatantly lying and emptied bank accounts and transferred property while in the presence of a person with severe dementia, and the solicitor has actioned it. All I can say is be prepared for a lot of lying and your ex's solicitor twisting everything. My trust in everyone being honest has been knocked and I find it unbelievable how some people act, they obviously have no conscience whatsoever. It's a strange world we live in ! Just a quick thought, if you got an estate agent to value your house with the idea of them selling it, would that be any way of getting information from Isle of Man, deeds, signatures etc?? I really hope you get this sorted in your favour as you don't need extra hassle, it's tough enough trying to cope without others being "horrible" (I won't say the word I want to use!!) Fingers crossed and wishing you every success in dealing with your ex. X

Yes somebody somebody suggested that to me, so I have written to all my neighbours and asked them if they will agree to give my solicitor permission to contact them , I have just finished writing the letters some about to post them, I will knock on there doors first. Liz,

GDPR is one thing but for official legal purposes some things can be disclosed so as others have said, your solicitor should know of the workarounds.

Finally, I presume passports were required for Tenerife to England moves, which leaves your ex with some explaining to do as to where he was living when not in Tenerife.

If he claims hotels then he has to prove it, (dates and receipts etc) if he says “with friends” then they can be brought to testify as witnesses in court and if they commit purgery, that is a criminal offence.

So whilst we are only scratching the surface here and only have limited information, take heart that of your ex thinks he always wins, he has only one way to go and that is to suffer a humiliating defeat.

And go for reimbursemnt of all your time, (record all the hours of phone calls, creating letters, stress to a disabled person and those of all your professional advisers and helpers. That will massively impact on him pursuing this against you and hopefully the weight can be lifted off your shoulders.

Thank you so much for your lovely and informative reply. I am sending my solicitor now everything that I have. My neighbours have all signed to say they will give affidavit to my solicitor. I have three more to collect and then he will take action. he believes his invincible destructible but he’s not. I pray for Justice and fairness many thanks again love Liz

This is horrendous Liz, I really feel for you. Electoral roll records are public unless you ask to not be shown in the public record when you register - your local MP should be able to help there, and possibly your local records office - or by using the Ancestry software in your local library.

The other place to look is Land Registry records of any property you've lived in - I think they'll send you copies of the register entries, I think it used to be about £10. You have the advantage that you know where you've lived with him. ( Many years ago I caught my ex husband out with a land registry request by the solicitor).

Is he possibly talking about tax status, or UK domicile? Did he travel backwards and forwards between countries while you were married? However, if he was married to you and he lived with you in the UK, any claims not to be UK resident should just fall through with the HMRC, because it's really difficult to prove that you're not UK tax resident if you live in the UK, even when people think they are being terribly clever. Perhaps your solicitors could contact HMRC to establish whether he had UK earnings? Or perhaps just supply a record of where he lived and worked to HMRC and let them investigate...

This must be so hard for you to deal with..... But as Shreds said, just because he thinks he always wins, doesn't mean that he actually will this time.
