I had capital of < than £6000 which was disregarded (which I spent last year on essential items) I have now received an inheritance of £9000 which will affect my benefit ( I accept this ) BUT will the dwp count my Capital as £9000 or add it to the previous declared disregarded Balance ??

They will consider whatever you have in savings right now, regardless of any previous (under the limit) amount.
This might be a good time to consider any further essential items you might require, if there's a chance that it will return you to below the limit.............rather than having an additional assessment afterwards. Best wishes
pjm, if you look on CAB website under benefits and capital you will see the scale for penalties, when everything else has been taken into consideration.
Would this apply if capital was transferred from a known disregard capital I.e.life assurance
Not sure about that. There are so many variables which are taken into consideration and these, of course, are peculiar to each individual. It's a minefield which I think pjm needs to tackle armed with much more information.
If you are likely to be getting any more large sums or money or would like to protect this one, I would look at a personal trust fund to look after your wellbeing
