how are some people winning esa tribunals and others like myself are not??

we all have the same conditions i was awarded 15 points and still ive been kept in wrag this is so unfair??

i dunno hun your best asking someone like c.a.b about this.i really cant explain and dont understand how the system works to be honest.or ring up the d.w.p and ask them for a explanation .x

The system is all to pot - I'm not very convinced that the people running it have much of a clue either.

Ringing up Dwp and asking for a written explanation as to their decisions is the best you can do. From there you will be able to dispute their reasons for the decision.

I can't urge peole enough to use the Benefitsand work help sheets. The problem with the ESA and DLA forma is that if you put very relevent things in the wrong box it gets completly ignored - in another part of the form the exact same statement would win you the award. The whole thing is designed to trick you into not making the best case for yourself and misplacing the truth; total nightmare!

The people who got the award put the right fact in the right place with suitable supporting anecdotes and evidence .......... and even then had to appeal or ask for a reconsideration! The system stinks!

Hi this has happened to me regarding my DLA, went to ESA appeal two weeks ago, I won. But now this morning had a letter from DLA saying that the paper work for my appeal has been looked at and I dont come under either Care or Mobility so I`m like you in this hole and dont know what to do??

I got 35 points at my tribunal and was still put into the WRAG, then had all ESA money taken away as I've been receiving it for longer than 12 months............ it's all a pile of pooh
