Work Reasonable Adjustments

I have been back from long term sick with a bad flare up for about six weeks now. I only just got my head of section to review my reasonable adjustments.

They are agreeing to me being able to work from home on Tuesdays and Thursdays. But they aren’t agreeing to my being able to work from home on an ad hoc basis on days when my symptoms are bad

They are saying it doesn’t balance with Business Needs and also trying to say it’s them exercising duty of care to me as if I’m not fit to drive then I shouldn’t be working. Which kind of shows that they don’t really understand this condition

Ive had so much sickness with fibro that I don’t want to then have to call in sick on random days when they just won’t let me work at home instead

I am going to formally speak to the union today and also Labour Relations but just a bit fed up that I have to do this. My head of section was very sympathetic and I got the impression it wasn’t her decision but coming from higher up.

Has anyone any experience of this? I’m not sure where I stand legally with this either ☹️

Hi kikimouse, Reasonable adjustments unfortunately have to fit in with the business needs, however they have to be "reasonable" reasons why they need to have you physically in work. You are covered under the Equality Act 2010. Are the reasonable adjustments that are in place those recommended by a qualified occupational health person or company or was it an informal arrangement?

I have been through the reasonable adjustments and although adjustments can be suggested the company do not have to put them in place. If they don't then they are open to a claim for constructive dismissal unless they have very good reason. Hope this helps
