Legal action for possible neglect

Hi everyone,

This is a strange one but I just wanted to see if anyone else had gone through something similar to what I have and what you did about it.

2014 - So me and my partner had been trying to conceive for about 18 months when I saw my gyny and they said I'd need another laparoscopy to see what was going on. Fast forward 6 months and I'd had the laparoscopy and they told me my endometriosis was destroying my eggs so they couldn't be fertilised. So we were referred for ivf.

At this stage let me point out that on my 1st and 2nd laparoscopies in 2008 and 2010, I had ablation treatment but in my laparoscopy in 2014 nothing was done.

I had appointments and scans and was given a starting date for my 1st cycle but nothing was mentioned about getting rid of my endometriosis to improve my chances of the cycle working.

My 1st cycle failed, at my review they said they weren't changing my meds or doing anything different for my 2nd cycle.

My 2nd cycle failed and that was our last nhs funded cycle. I didn't receive any aftercare and I can't help but think that if I had had my endometriosis treated then one of my cycles might have worked.

Has anyone ever gone through anything similar and took any legal action? Or does anyone know if I have a chance of getting anywhere with a case?

It a hard one but i dont think u have any legal action.. it just a chance u take...

I have endo, my best friend has it... she was told not to bother having the op as the hormones through the ivf would still work endo or not... she had two lots on nhs then two lots private and nothing.. two years later she gave up hope got a dog and forgot about it and at 36 she got pregnant TWICE!

So i think it case of luck!

She was told her eggs were allergic to her husbands sperm that why it wasnt working????

Obvious that was wrong.

What im trying to say is she never had any endo ops.... she still got pregnant ... and naturally not IVF but i dont think u can take legal action for something they didnt do as i think them not operating if u want to get pregnant asap is normal as they know it works with or without it and they also dont want to mess about with ur reproductive area if u do want kids

I don't think you have a case, it doesn't sound like you sought a second opinion, and (this sounds insensitive, but is not intended that way) no harm has come to you from them failing to act. You can't prove that their actions prevented you from conceiving, the law likes things to be clear cut. I'd also say that as a patient you consent for whatever treatment you go ahead with. That should be informed consent, so if you have any concerns or questions, they should be asked before you go ahead with treatment. Unless you can prove that you did not have the capacity to consent or that you were misled, I personally would advise you to save your money and a few grey hairs.

I’m sorry for what you’ve been through I had a 7 year struggle to have my daughter mainly because it took so long to diagnose endometriosis 🤦🏽‍♀️

I can’t advise on whether or not you have a case I’m not legally trained!

But I think that you need to follow the correct procedures- you need to find out what the hospital complaint procedure & follow the steps before you can take the matter further. If no joy then go to the GMC.

I recently took a complaint to the financial ombudsman against a energy supplier I’ve had ongoing issues since March if I hadn’t tried to resolve the issue with the company the financial ombudsman wouldn’t have taken my case. A company has 8 weeks to resolve a complaint.
