I'd also appreciate some help in this area as after having 2 operations, one in November and I was off for 6 weeks and another in Feb and I was off for 2 weeks I feel my managers and work place are trying to bully me out of my job now. I think they see me as a total nuisance when they could have someone else in who isn't ill. xx
I am not an expert in employment law but I have just had a meeting with my unison rep as I have a formal disciplinary pending due to my sickness/absence. She told me that, for the purposes of employment law, any illness which affects you for over a year must be considered a disability therefore by disciplining me, my employer is discriminating against me and is in breach of employment law.
Thank you. I'm not sure if it's there same where I am because I'm not on mainland UK. However, I would think so.
