PIP Appeal

Hi,

I have received the DWP's response to my appeal and I was just wondering if anyone knows if you can send in more information to the courts before your appeal is heard. I think what is annoying me most, apart from the inaccuracies that I have already argued about, is that the assessor said that I agreed with her report, but I never saw it and she certainly didn't waste her time going through it with me.

Sorry to waste people's time, but any information would be useful.

I'm trying to be very calm about this and not get stressed, but I actually get very angry when I think about people that are a lot more disabled than I am.

Any comments are most welcome. I really rely on this site. You all keep me sane.

You certainly can send in new evidence. Why not ring the BLF helpline on Monday morning? They are open office hours on 03000 030555 and you can book a call back from the benefits advisor.

You can send in new evidence to the tribunal hearing. It is better by far if you send new evidence before the hearing and not on the day, I suppose it so they can browse it before you attend.

You can send information to cleark of tributal with case ref nummber name address ni number on it.

Medical evidence must be in relation to claim AS they will not hear any new issues not mentioned on your dwp claim.

What I mean IS if I claim for broken leg YET at tribunal I say my head fell off they would not hear medical evidence unless it’s about my leg.

Go to your Dr and ask for a written report of your illness. As they seem to be refusing everyone. Even where home oxygen is in clear use. Just keep appealing and good luck.

Yes, my feeling is they do not like to award PIP for COPD. I got points for tendonitis, but nothing for severe/very severe emphysema.

Hi ,get some Imput from your g.p. About the way your copd effects you mentally,and dont worry about the tribunal as they are very informal and give you the chance to explain the difficulties you face day to day.good luck

This goes on all the time, some forms have been changed beyond recognition and the client has not been aware, a friend who is wheelchair bound 24/7 was said to have walked around her room .

I think the interviews should be videoed and all reports photocopied .

this is so true.. i was in on an interview with a man with stage four cancer who has suffered awful surgeries due to previous tumour removals.. the lady that came out was lovely to him but then told a lot of lies in her paperwork.. saying he could do things he clearly can't.. this is a sad state of affairs.. go prepared and know these people you will be seeing are not on anyone's side so plead your case.. good luck.. let us know how you get on...

@ i had this done to me first time i left it but second time i went to appel. If you are confident enought go one your own .if not take someone with you. There is one doctor. One lawyer. One other person. It not as bad as it seam . But tell them every thing you cant do .

Hi,

Send in everything you have sometimes the appeal can take awhile my son waited a year for his and we sent in letters all the time, although they have to be for conditions you already suffer with not anything new. It sounds scary but in our experience it wasn't , and we were successful . Wishing you well. You could also look at benefits and work site they have lots of info on this.

When I had mine 2012 I was only allowed to send information up to the date I claimed, however I would think that anything that describes you condition and how it affects you would be helpful ?

On saying that, the DWP do state that you need to let them know of any changes?

Hi Anng1814, you certainly can send your response to DWP letter., and of course they must sign for it, and keep all copies.

Thank you. I have just been looking at the PIP assessment guide given to the DWP's assessors. I am really wondering if they understand what they are assessing and how they should do it. I don't know about you, but I do everything at a slow pace and need rests in between.
