NEW SCHOOL SUGGESTED NEW EVALUATION DUE TO NO REASON FOR IEP ACADEMICALLY AVERAGE OR GETTING THERE. TEST AT SCHOOL ARE NOT GREAT SPECIALLY SPELLING TEST 5/20 AND SO STRUGGLES IN WRITTING SENTENCES ARE MORE LIKE 1ST GRADE SENTENCES. ALSO THEY WANT TO REMOVE BEHAVIOR PLAN. HE HAS ADHD AND IS REALLY IMPULSIVE I DONT AGREE ON THIS HES DOING SO MUCH BETTER I BELIEVE THIS WILL AFFECT HIM. THEY ALSO SAY THE DO NOT HAVE OR PROVIDE COUNSELING THROUGH THE DISTRICT. I AGREED ON THE ASSESMENT TO CHECK WHATS IMPROVE AND IF ANYTHING ELSE IS GOING ON BUT WHAT HAPPENS AFTER......ANY ADVISE

I’m going through the same thing. The best advice I have is to get your own outside assessment, if possible. And find an advocate. Many school district have free advocates if you can’t afford an attorney. The school will test him, but in my experience they will test his strengths and not his weaknesses just so they can say he’s improving.
Does your son’s IEP include measurable behavioral goals? Is data tracked to illustrate progress towards his goals. Has he met the goals in his current IEP? I don’t understand how they can say he is doing well if he is getting 20% on spelling tests and writing first grade sentences although he is in fifth grade. Does his IEP have academic goals? If not, there should be ones to address his language arts and writing skills at a minimum. Does his IEP have an accommodations?
Your school district belongs to a Special Education Plan Area ( SELPA). The SELPA collaborates and provided certain services to students. Call the SELPA and explain your concerns. They should look into your son’s case and guide you and or the school. If this gets you nowhere, find an advocate. Oh, and I agree that you should request an independent evaluation is referred to as an IEE. An IEE is at no cost to you but verify such.
