my wife is due to attend an appeal hearing relating to her incapacity benefit being stopped
Hope she has arranged for someone to go with her as I got very tired and confused so they took over. There are usually 3 people who ask questions one by one, they are kind and gentle with you. Its wise to answer as a worst day even if they ask about a good day. Dont be quick to answer and dont give too long answers with more info than they ask unless you are stressing your difficulties. If you go to Gov.com there is a guide on there for tribunals. Good luck and dont be frightened to say you need a drink, move about, stand etc.

I am also waiting,my money was stopped back in Feb and i am told it can take a year or more.You can get partial payment while you wait and that is the situation i am in, i am dreading the winter as i cant afford to put my heating on unless i win very soon.
Another possibility is 'Benefits and Work' website. They have loads of information to help you.

Kevneedinghelp I understand it is stressful for your wife.
They will just ask about her health what she can do. I don't know her medical problems but when answering just remember the esa form says you have to do reliably and repeatedly before pain or severe discomfort. If she can't say no and a short explanation.

Also avoid giving too much additional information unless it positively supports the application. If you look at the Ben and Work website it really gives a lot of pointers. I can only say that I really wish both you and her well when you do go.

At my appeal tribunal there was a doctor and a lawyer. They asked a lot of quite in depth questions about my illness and how it affects me. Try and concentrate on answering with the worst case scenario - how your wife is on her worst days and why that prevents her from working. And don't worry about getting upset or angry, let them see exactly how it is. I found it hard and draining and felt at the time that it hadn't gone in my favour, but I did actually win.
My tribunal was similar to Janericat and I had just a GP and a lawyer, I went on my own and I answered honestly but using my really bad days, I found them both to be polite and considerate. I was then asked to leave the room for 10 mins or so and then was called back in where they gave me the result there and then as ATOS had awarded me a great big fat 0, and they awarded me 18 points. I shook there hands and thanked them for recognising that I was unwell. It was not that bad at all so please try not to worry too much.
I am now awaiting my 2nd tribunal as ATOS awarded me 9 points this time around which is not enough as you need 15 or more.
