Has anyone been successful claiming disability through Social security? I’d be so thankful to speak to anyone who even tried to get disability. I can’t take this much more

Yeah, apparently everything they told about me wasn’t believed, they decided I could do everything I said I couldn’t do. I was seen by a young girl at the assessment, but the letter I received was from a guy saying, “I’ve decided this and I’ve decided that”. It wasn’t even him that saw me. It’s all a farce, but I’ve been told by many to appeal against it because they tell most people no to start with.

Here in the UK it is very difficult to get benefits for disability and as most doctors know very, very little about RLS or how severely it affects patients, they are unwilling to write reports that will help claimants.

It is something that we all need to campaign about- RLS is a severe disease and causes more suffering than many other neurological diseases- but try telling that to a benefits assessor who knows even less about RLS than the worst doctor! I live in hope that more research into RLS will reveal how difficult it can be to work full time ( or part time) with this condition.

First of all thank you for the reply and I hope you’re doing well and feeling better. I’ve heard it’s almost impossible to get SSID for restless legs syndrome. Wondering what the doctor needs to say how he/she needs to say it. Is there a magic formula. I get about 2 hours sleep per night. I’m a teacher and I drag myself into school because I’m out of sick days. My productivity has been next to nothing and I don’t feel like I’m helping the kids at all by being there. Which makes me feel even worse.

I applied in 2006 and was rejected twice. I got a lawyer which specializes in disability cases. My issues were my back. At that point I was using a cane. But with my hearing in 2010 I won because:

1. My back injury (two surgeries in 5 yrs)

2. By this hearing I had to have three hand surgeries (bloat carpal tunnel and a trigger thumb)

3. I had 20+ yrs of work history

4. My work was specialized in only one area and training - nursing. I was not qualified for any other job

5. I went back to school for another area and couldn’t complete due to my hand problems

So it was determined:

That I could not sit, stand, or walk for more than 20 minutes at a time. I was specializing in only one distinct field. And all my surgeries were within a seven yr time frame.

The findings were over in two months. I received a $20k back pay but I only make $1175 a month. I get Medicare but make $120 too much to get any Medicaid. I can’t love on my own with this amount.

My daughter won her case (at 18 and no work history) only because I was receiving it even though she was on dialysis (she got a transplant in 2012). She was awarded half of what I made as a ‘rider’ on my case. She gets $530 a month. Receives an additional $210 from ssi (in Indy the cut off amount for ssi help is a total of $780). She now has a part time job to help us out. As long as either of us make less than $900 a month we can still receive our benefits.

Remember that even if you do win (based on health and work history) you really don’t get much. I’m 55 now so I will not get full benefits till I’m 67 it should be around $3000 a month by then. Unless you have worked 15+ yrs at a great paying job (about $50k a yr all that time) you will get as much or less than I get.

Thank You for telling me you’re story. I was hoping you would explain something about RLS. I have it and want to use it as a basis for gaining disability.
