Another obstacle :(

I am looking for some advice. I made a decision several months ago to find a suitable home to have my Mum with me (Mum has CBD and my home is not suitable). I informed SS of this plan and last week eventually found a suitable bungalow which has now been secured. Mum is aware that we are moving in at the end of the month. SS encouraged me to apply for CHC funding back in May which is taking a very long time as the case was not submitted correctly. I now have been told by SS they will not provide care for Mum in the new home as CHC is pending. Although they will continue in the interim if she stays where she is. (Sheltered accom with extra care) Despite my Mums deterioration and mental health being away from me, said care facility have made no less than 7 medication errors. SS seemingly think this is the best environment for her until CHC make their decision. Does anybody know if I can argue this? Mum has been moved from pillar to post in the last 15 months and now we had a light at the end the tunnel SS have put another obstacle in the way!! It is never ending! Peace is all I would like to care for Mum as only I can..(with adequate support)

Medication errors are very serious. I have seen homes closed down because of ongoing medication errors. I would have a chat with your Mum's GP. If they are making errors with your Mum they are doing the same for others, some of whom may not have family close to notice.

There is no such thing as a case not being submitted correctly to the CHC. A request for assessment is all that is required. If/when you get funding establish that date and they should pay from then.

I'm not sure what you mean by 'argue this' do you want to argue she stays there or argue that she move? Part of the CHC process is to establish her needs and to ensure that there is a care plan in place to meet them. That care plan will include where she might live. They make this decision in collaboration with you and your Mum. They cannot force it upon her. If you have concerns about medication and the home for example you need to talk to them about that. One solution might be that a community nurse checks the medication weekly.

What obstacle have Soc.Serv. put in the way?

It sounds as if you are winning. If Soc. Serv. are saying you should have CHC then they are really saying her care needs are beyond the Social Services (Outwith their legal limit) under those circumstances CHC are obliged to pick up the care and to fund it.

It is the refusal to provide me with social care support when I move my Mum at and of month. CHC has been to panel and not refused but lack of evidence. Another meeting Thurs. Mum has carers and PAs now but if I move as planned this will be taken away until CHC is decided.

The key thing is your meeting on Thursday.

There is a line of responsibility drawn between Social Services and the NHS. When Soc. Serv. assess in situations like this they have to make a decision as to whether or not it is, "Beyond their legal limit." If they declare that it is then they may no provide care under any circumstances. It sounds like this is what they have done.

When this happens the CHC have a duty to accept care. They can huff and puff about evidence all they want, bu they may not leave your mother without care. So, for example, it is not permissible for Social Services to say it is beyond their legal limit and for the NHS to say that there is insufficient evidence and they won't provide care. They must provide.

Having said that it might be that the CHC funding panel think that the Assessor has not been thorough and they are asking them to look at some areas again.

Should you fail to get the funding the next thing to do is to get Social Services to declare that the care is beyond the legal limit in writing to the CHC and then write to the CHC manager stating that fact and asking them to fund. I have seen a few people get their funding by doing that.
