I'm sitting here feeling rather sad and angry at the plight of so many of us struggling to get CHC funding whilst struggling with the enormity of daily care and the emotional impact of it all.
So I thought it timely to remind folk that if the Social Services decide that the care is beyond the, "Social Services legal limit." Then legally the CHC has to pick up the baton.
Only social services can declare if the care is within their legal limit. Part of the CHC assessment requires a Social Worker trained in assessing the legal limit, to make a decision on this very point.
You have a right to request a copy of their decision and how it was evidenced. Yes, they have to cite the evidence underpinning their decision and you can ask for them to re-assess too.
