Adult safeguarding and court of protection

Adult safeguarding have got involved due to concerns of risk my son poses to himself and myself and husband whilst at crisis.A safeguarding meeting was held between professionals to discuss a plan.

Safeguarding have come back to me and said they are going to the court of protection to make a decision for my son.

Any one been in this position that can offer advice please ?

Shouldn't mean you stop caring for him or looking after his best interest. You have to fight to stay in his life and ensure their care means he really is getting the best treatment and help and not neglected or abused by them xx Locking him up or restraining isn't best method but control by himself best way forward and they have to do this through behaviour therapist or therapists helping him properly

Thank you, Ive been thinking whether I am best to apply for deputyship. .but not sure if i can with safeguarding going to court of protection

yes you can and upto courts to decide whether you get but based on what you have told me you guys really need protection from deputyship x

Before any hearing at the Court of Protection I would ask the judge to reject any application for a 'Transparency Order' by the professionals, as they are known to use this tactic to sweep their own side of the story - warts and all - under the carpet and out of the public eye. Certainly protect the identity of your son and yourselves by maintaining anonymity, but insist that the professionals are identified and their submissions published (with your details redacted of course) as it is the professional's job to ensure that not only are they acting in your son's best interests (and not just "seen to be" acting like they might ahead of a CQC visit) but are also acting in the public's best interests. After all, we pay for these services through our tax and rates if not privately and we have a right to know what actually goes on.

That way you are free to talk about the case - unlike our own dealings with the Court of Protection, where our hands and tongues are tied until our relative passes away!

Good luck, and I hope it turns out the best for your son and not (once more) for the professionals' best interests!
