My son has a pip court hearing this week . Any advice you can give us or what to expect would be help thank you

Hi, you don't seem to have talked about any diagnosis in your past posts. What is the background medical story following the head injury. Has he seen a neurologist, neuropsychologist, physio's or had scans or tests etc. It would be hard to win a case with no medical evidence.

I think I have talked about it . My son had a brain abscess in 2013 he had to have two craniotomys to try and get rid of the abscess and a 3 month stay on hospital. Ever since he has lived with chronic head pain . And because of the ab he now lives with epilepsy too . And a rare skin condition that leaves painful lumps in places where you don’t want painful lumps !! His 23 now never worked hates his life and hates living like this . His finally been offered Botox in December so we are hoping that could help him and we are finally going to a pain clinic in January ( never knew about this ) untill a few months ago . We have all the medical evidence and I think Harry’s scar which is from his ear to ear is prof of that .

When you are asked questions by the panel, your response is effectively your testimony. Use your responses to clarify and state your case. Good luck x

Also. Don’t them bully you. Ask for clarification/ time if you need it.

Why you are having to go to court beats me after reading this. I assume you have sent them the evidence or provided the contact details of the agencies involved. Have you contacted your MP about this situation. I did the first time I applied for PIP and they awarded it without any problem after that. I applied again in the summer this year for the second round thinking I'd get nothing, but it was awarded because there are still some minor issues that was picked up at a neuropsychology assessment. The system is baffling. I wish you luck and hope it all turns out ok.

Does your local council have a welfare Rights dept. ? If so they can be very helpful in benefit applications. They went the extra mile in supporting me and even accompanied me to the tribunal after my first claim was denied. The CAB too (if still operating in your area) have expertise in benefit issues.

Hi thank you , they do have all the evidence but because my son looks normal they gave him 0 points. I haven’t been in touch with my MP I didn’t think about doing that and she is very good too . Maybe that’ll be our next step if we arnt success full this week .

hi I just wanted to let you all know my son won his pip appeal!! He has Botox booked for December and his been referred to a pain clinic in January so fingers crossed these things we help him and will help him change his life . X

That's wonderful news!(It all helps, be open to what works, and do keep in mind this is like an onion - there is always one more layer - slow and steady does it... so, pace yourself.. )

So happy to hear this 🎉. You must both be so relieved. It will take a while to sink in. Any back-payments will take about 6 weeks..

Dear Harrys,

I don't know how relevant, or not, this is going to be to you but....

Back in 2016 my 'Benefits' were Stopped, after I had Had a 'Review'. I had provided a LOT of Expert Testimonies, regarding my Condition- some from London Doctors- Clearly Stating that I Was Unfit For Work.

I Appealed this decision and..... My Benefits were Restored- at a HIGHER Level than previously! This was based on Exactly The Same 'Submission'.

I don't know your Position/ Circumstances Harrys but, if you do have Medical/ Expert 'Backup' then DO Appeal. I found The Panel- consisting of A Doctor, Someone from the DSS and an Independent- Very Fair Minded indeed. Definitely NOT the 'Heartless B*s***ds' they had been described as.

Things might have 'changed', a little- especially since COVID- but the Panel are still people! Personally I would Appeal providing, as I said above, as much Evidence as you can (often Family/ Friends can 'attend', sometimes even 'Speak' to the Panel in support of you).
