Really annoyed just had an email from work telling me I'm not entitled to ssp. I've checked the criteria and am sure I am and think the mistake is because they under paid me last month. Really annoyed. Asked them to give me the number for whoever does payroll and once I've spoken to them tomorrow partner and I are going to take legal advice. Xx

If on a full time contract, you should get ssp at full pay for six months, it then drops to half pay for the following three months, and a quarter for three months, it then drops to zero. Ssp is not a choice your employer can make, the clue is in Statutory i.e. legally bound.
But as a caviat if you have had any sick leave upto 364 days prior to this sickness, then ssp is calculated from the first day of the previous sickness. Therefore the ssp would be calculated from the first day of the original sickness.

Thanks for the replies.
I have spoken to the accountant this morning and they are trying to say that it's because I hadn't worked for the company for 8 weeks before my accident (which technically happened while at work) and therefore hadn't earnt enough. There is no mention of this on the HMRC website.
The worst bit is my ssp is theyjust the minimum they have to pay which is 94.25 a week, which is annoying that they won't even give me that.
According to the accountant if I take the ssp1 to the job centre then I'll still get ssp, but everything Ive read says this isn't true.
Am going to pick ssp1 up tomorrow when I take my next sick note in as still don't feel able to go back, in fact this morning I woke up feeling really achey again and even had trouble opening my eyes and getting motivated to get out of bed. Once I have this I'm going to contact the HMRC for more advice.
