The persecution continues.....

I've been fighting the DWP for the last three years,

Dec 2012 went to the ATOS interrogation, scoring the obligatory zero points, appealed same day I received their letter.

Fast forward to this year, and having gone through the first tier tribunal (FTT) up to the upper tier tribunal (UTT) who have ordered the FTT to reconvene at the earliest opportunity and conduct the FTT lawfully, all the time living on my Army pension, and whatever else I can beg or steal, as the 365 day limit for payments ended in Feb 2013 (placed in WRAG not SG).

I received a new ''assessment'' with another of their fake health care professionals!

This time for the end of this month.........I currently have a Royal British Legion 'independent living advisor' helping me with the tribunal case and I spoke with him last week to get his advice on this new assessment, he was of the opinion that I should NOT attend it, as I already have a case on going which has yet to be finalised....

I have spoken to ATOS/Maximus or whatever name they're calling themselves lately, who clearly have no other interest but to get paid for interrogating me, then I spoke to the ESA unhelpfull line, again telling me I should attend, then to the HMCTS who say it is entirely up to me whether I attend or not, as it will have no bearing on my tribunal case......confused? Very!

Depressed, anxious, tired, and utterly raging...you bet!

Now I have to pester a friend to come and sit with me for however long the interrogation is going to last this time round, although I have always gone on my own before, I don't see why I should put someone else through the ordeal of the interrogation, I wonder if I can get a news reporter to go with me?

Get your MP on your side, now. Write to him/her outlining the exact details of your battle and your own health and the impact the stress is having on it. It helps, trust me.

If you trawl back over my own posts on this site, you will find posts a couple of years ago relating to my own war with the DWP, ATOS, etc, etc.

Medicals, interviews, tribunals, lies (proven) more medicals, and so on and so on.

Fight and fight hard. Get all of the health professionals you have ever had dealings with to produce a letter backing you and outlining your medical past. The more backing you can get, the better. I had two doctors, a rehab Ward, a heart specialist and a psychologist produce letters of evidence. It ALL helps. My MP chasing them was the icing on my own well prepared cake.

Bake your own cake and throw it in the heartless b**tard's faces.

Cheers Andy, completely forgot about the MP, and she's new in her post too but a rotten stinking Tory so I won't hold my breath, but an avenue I forgot all about.

I have just had my weekly EFT treatment (Emotional Freedom Technique) or 'tapping' as it is more commonly known, so I am in a better frame of mind now.

I will chase her down this week and email her my encyclopaedia of events.

My own MP is a long standing Tory with millions in the bank who wouldn't know real life if it smacked him in the face, but, amazingly, he was superb where my case was concerned.

Hi Baron,

I'm guessing your local MP knows full well that bad news and press locally causes more damage to his prospects than ignoring you. Plus one case put through can be used as propaganda that the blue party aren't as heartless as they are made out to be.

I am wholeheartedly with baron c on this.

All I can add is to collect every aid you use whether it is physical or paper reminders and take them with you.

My timetable, exercise list, shower cheat sheet etc go with me.

Are we all SICK of begging, try jump through their hoops, try fit OUR difficulties into THEIR (non-human-shaped) boxes?!

And then oh: STILL not enough to live on for even a BASIC life. After all that which includes time, energy (limited for us), money (transport, photocopies, pens+), stress, angst, FEAR and time-limits and re-do-its after 6 months/year = all hanging over our heads = NO time really when not fretting about it all.

And fearing /renewal' time. Fearing replies and yes: those TERRIBLE brown envelopes (doing cartoon about them strangling me, attacking me = drones from afar bombing me).

And the ARGUING: trials (court) but NO government help (except when they pay money to charities to do = ??!!£) and charities overloaded, can't help everyone.

How to do it better? Up to THEM to prove we're liars. Up to THEM to cost things properly and include OUR real needs/costs up properly = REAL world and yearly, not their stupid 'basket' that doesn't reflect our costs' inflation.

Yes: they must GET REAL. Need to tell them how it feels and IS. And SICK of being described as greedy, too-demanding, exaggerating, fabricating, looking for attention. Belittled = cruel, dehumanising and a betrayal.

If they spoke about other minority groups (eg races) like this they'd be accused of hate speech but apparently it's OK to talk about us (and treat us bad) like that. Why the difference?

This scenario seems to be the norm these days. Whoever voted Tory last week should hang their heads in shame. I had the same problem about 18 months ago. I turned to my MP and within 6 weeks I had ESA and PIP sorted out to my benefit. So maybe that's a option you could take

I was going to refer dial@p-d-f.org.

They deal with all this benefit malarky and are very good.

I have a friend who works their who used to volunteer for our Headway, Portsmouth and SE Hants. She left in 2008. Her name is Maria Graham, don't know if you know her too?

Anyway, dial was who I was going to refer but Andy's idea about contacting your MP sounds good too. Way to go Andy :).

Either one is a good choice, I hope.

Well well well, forgot to update this, sorry!

It seems that the DWP have finally caved in. I won! After 3 exhausting, mentally draining years, they have finally capitulated and placed me into the support group.

This is after they ignored the judge, not once but twice, the first time he had ordered them to attend the tribunal and explain why they had failed to supply any evidence to support their argument, and why they had failed to respond to his direction.

The second time, they again ignored his demand to reconvene a first tier tribunal as soon as possible, this time to be carried out lawfully, and again they were to attend and explain why they were ignoring him.

They simply stated that the appeal had lapsed,and a decision maker had placed me into the support group, backdated to February 2013......absolute relief, when I read the letter 20 or so times, I rang my Mum, who was almost in tears, I then had to get someone else to read it and see if they came up with the same conclusion as me.

Oh and the WCA that they were demanding I had to attend, last Friday, yeah, they cancelled that the evening before.

This corrupt rotten to the core government is truly immoral, criminal, and ignores any justice.

Great news, I'm both happy for you and seething that the corrupt b**tards are still inflicting this upon the innocent. I still feel bubbling anger after my own DWP trauma came to an eerily similar ending as your own experience. For now however, just bask in your triumph, relax and enjoy it.

Karma will deal with those people eventually, watch this space..

Yes the sense of relief was literally overwhelming, I didn't realise just how much it had affected me, once I had confirmation that I was in the SG I felt like I could've slept for a week!

Of course, they will get their comeuppance eventually, may they be on the receiving end of their divisive social cleansing legislation some time soon!

I still have my complaint of maladministration and discrimination which is just reached the dizzy heights of the ICE, Independent Complaints Examiner.

And now I also have a fight against my local authority (council) due to them deducting housing benefit off my current entitlement, due to the backpay the DWP gave me, when they placed me in the WRAG after 10 months being 'fit for work'.

But I'm looking forward to it, and I have just been told that I am out of time to complain, we'll see, there is something unlawful going on and I am certain that when I inform them of what it is and expose them, they will capitulate and return the 'overpayment' to it's rightful owner!

Hi Boo,

Good to see your news. Hope you get the rest.

It also fills me with rage every time I read stories like yours.

No one who has had a brain injury should ever be subjected to the stress and mental torture that these situations/ people create.
