Hi everyone. My last post was i was refused pip . To remind you i only have one lung and asthma in my remaining lung. My enhanced mobility on DLA was stopped .After 7 months of refusal at every stage my tribunal hearing has now arrived. Two weeks from today.Will update you all whatever the outcome.

Toby can you at this late stage get the help of a benefits expert - welfare rights, CAB or DIAL. This doesn’t sound right at all if you were on enhanced mobility. I assume you have not answered straight yes or no to everything, but explained how long it takes you to do things because of pain or breathlessness. Maybe it would help to give BLF a call for some advice.
I wish you well and hope you get some help with it. Call me synical but I feel bringing in PIP and changeing the criteria to 20 rather than 50 was a ploy to remove lots of people on permanent DLA but I think it has cost a fortune as many of these decision are overturned at tribunal.

Hi Cofdrop, Yes i did get help filling the forms out, I’m with Age uk. I was on DLA for 23 years. I sent in support letters , scan results and umpteen letters of support. All to no avail. In my assessment report there were things that i never said. Actually i cried when i read it as who was going to believe mei stead of a official.
But i have got some fight left and i’ve been busy with Age uk writing my final points of disability,

Go immediately to the Citizens' Advice Bureau, Age UK are too far away from the action. CAB will in many cases send an experienced person with you to speak on your behalf. He/she will have dealt with many such cases locally and be used to dealing with tribunals. The volunteers that work there obviously like to win their cases and yours sounds like a winner to me. 😉x

Good luck Toby14. Just remember your painting a picture so a stranger can see by your words just how difficult every action and every breath you take is. Describe the worst scenarios, how you gasp for air etc and how painful every movement is. 🙏
Ps you can have no limbs at all but if they think you are coping well you won’t get the award !! It’s important to show how very difficult any action is for you.
The problem is that people like Toby14 are so used struggling on, trying not to whine and moan and make a fuss, are suddenly faced with a situation where being brave works against them. It's alien to them to present themselves as unable to cope. It's disgraceful that the claim has reached this stage.
Remember pip is based on how your condition affects your daily life so get lots of written back up from doctors, physio if you have one etc.

Good luck with this makes me angry when I see my neighbour prancing around knowing she gets pip when people who need get get turned down.
I know how you feel.I have a neighbour who gets full care and mobility and manages to sneak out and work on the side.Its so unfair

Hi Toby14 praying for you I hope everything goes well for you I was thinking would it not have been better to try for a home visit and have someone from CAB with you, with the weather as it is it can’t be easy for you to get out in anyway fingers crossed and all goes well
I did try for a home visit but the man on the other end of the phone gave me a stern'No,. Iam with Age UK
It isn’t a home visit that you need, it’s someone to attend the tribunal with you. Citizens Advice Bureaux will often do that in deserving cases which yours is. Please contact them Age UK is too remote.
Good luck but don’t forget PIP is based on how far you can walk and how much you can for yourself. My advice is to exaggerate a bit without going OTT. The good news is most appeals are won. Good luck

Ask your local council if they have a benefits advisor. Some still do and they can be really helpful
I have applied twice - if I get refused this time I am going to Appeal - How would they like to live like I do! As long as I don't move and go slow it's ok but this is not living -

Hi. I won and was awarded enhanced mobility which I lost. I left a post on here 2 weeks ago. The judge said it was clear I would never get any better. I was awarded back payment as well. The next review in 10 years. Glad it's all ovet
It is not acceptable that genuine individual like yourself is going through unnecessary distress by being forced to go to tribunal. Tribunals are apparently costing up to one million pounds a week. The government needs to sort out their department the DWP and these assessors who are writing inaccurate reports. These assessors are professionals with regulatory bodies. There is a core of people who shouldn’t be getting assessed at all due to their health conditions or have light touch reviews. They should never have had private companies doing these. I’m glad you are sorted it sounds a nightmare with going to a tribunal.
