I have sleep apnoea and work as a health care support worker and have been excluded from doing nights however my employer states as I can

meet the 24hr service they have moved me to the community I am not happy can they do this please help

Hi you need to check your terms of contract Are you in a union? Are you medically excluded from night work? If so seek help from your doctor. You can also contact ACAS - google it. They are experts in employment law. Good luck x

I can't see how they can do this because as long as you're on treatment for your sleep apnoea there shouldn't be a problem, you would just use your CPAP for your daytime sleeps. I have lots of sleep tech friends (mainly from the USA) and many of them have sleep apnoea themselves and work nights in the sleep study labs. Definitely check up on this.

Don`t understand their thinking.

I am an x LGV1 driver and was still driving LGV when I was diagnosed with SA.

And a lot of my friends still drive LGV round the country LEGALLY with the approval of DVLA as long as your hospital SA consultant can say you SA is controlled with CPAP.

Ask your SA team to give you advise.

Sadly government change the rules to suit them and will always come down on the side of the employer it wont be long before we get slave labour back, if you look at the changes they have made to people on disability and if Ed Millerband gets in next time young people wont be able to claim ESA unless they do tests and get qualifications and those kids who's parents earn over amount set by them there kids wont get ESA.

If it is legal what they have done I would go and get free advice from a employment solicitor it is also worth you contacting your CAB office good luck I do hope you get this sorted
