My ESA was back dated 13 months after I had the decision overturned at tribunal, you do need to be put in the support group if you are on contribution based ESA as you only receive it for 365 days in work related group,

I hope you have a welfare worker or support from CAB for your tribunal, saying that I didn't but I was fortunate that the doctor new about PBC and the judge listened to him .

Hope this helps and good luck

ESA is divided into two categories in the work related group you attend interviews at job centre and they encourage you to return to work,in this group if your on contribution based ESA you can only receive income for 365 days then you are moved to income based ESA so if you have a partner who works you probably won't receive any income.

ESA support group is for those who are unable to work and need help and assistance in any way,you are then paid ESA at a higher rate,it's very complex I hope I have not confused you your welfare worker might explain it better to you.

I would agree with Nesta, make sure you have someone with you CAB or welfare support. When submitting 'evidence' of iyour illness always make sure you include any letters from hospitals, fort both check-ups and tests to help 'prove' you've been to hospital. Its ridiculous that we have to do this but then in a way its a good thing cos genuinely ill people won't have a problem 'proving' their illness. Hope some of this helps and good luck for your Appeal.
