dotty this is not a g cometance everyone has a right to live where they want to if a home cant be afforded rivatley then an alication to devon adult social services who will arrange and part fund the care then devon housing to find a home the only inut the gp has is medical records and a letter supporting the need for care

i had the same when trying to move from kent to wandsworth nearer friends and familyl

Hi dotty1971,

Thank you for your post and sorry to hear of the difficulties you are experiencing.

The best way to approach this really depends on your brother's current situation - for instance, his mental capacity, where he is living (eg a hospital, rehab unit, care home, in his own home) and what services he is receiving and requires from the NHS or local authority. He should have a legal right to move though, so I am not sure what the solicitor might have been referring to.

If he receives quite complex care it may be that no services are available in the area he is moving to that can provide this - and if he does get support from the NHS or local authority social services they will need to perform an assessment of his needs and put a package in place. In most cases contacting the Devon Adult Social Services would be a good place to start, as ncmurphy says.

There is information on out of area treatment at dh.gov.uk/prod_consum_dh/gr...

The information on page 38 might be helpful, 'People moving from one local authority area to another of their own volition'. If he moves, he should become 'ordinarily resident' in the new area and funding should transfer.

I hope this information helps, and please don't hesitate to contact our helpline on 0808 800 2244 or helpline@headway.org.uk if you would like to discuss this in more detail.

Best wishes,

Headway.
