Sadly i dont know, but a friend broke leg 3yrs ago and still going via legal route as still awaiting more surgery due to breakage, shes still not had outcome. It varies with legal route but with covid sadly this could take a while longer.

Nevertheless, you need to maintain your own wellbeing during this timescale to ease the unwelcomed stress . Always have someone with you with telephone calls with all legal stuff, as you will be overwhelmed discussing situation and that trusted person with you can take notes to help digest.

Im sorry your having a difficult time with this added pressure.

Forgot to add, glad to see your post though, was thinking of you from last post hoping you were safe.

Hello there I’m so sorry that you’re mired in that awful process. I’m afraid it’s a long haul and depends, to a large extent, on your opponent.

I used to be a solicitor and I was still unprepared for the hostility and shocking behaviour of the defence in my case. They drew it out for 5 years before finally settling 1 month before trial, even though they admitted liability a year before that.

I’m sorry but I don’t have time right this minute to check your posts to see what’s going on.

Are you at the stage where you’re being seen by their medics?

The adversarial nature of our legal process is awful and has a terrible impact on the claimant - you’ve already endured so much, are doing the best you can to get better and now you feel under attack.

I feel so strongly about this that I am now getting involved in the training of case managers and lawyers and I am here to help you if I can.

Best wishes

F

Thank you for your message I’m currently at the stage of seeing my solicitors professionals I’m not looking forward to seeing the other sides it’s bad enough seeing the ones from my side

Thanks again

I had brain injury in 2014 and I just finished after long 6 years waiting 2021 The reason of it was b/c it was hit and run so the government have to deal with it (MIB ). One thing I understand from this process is every person case is deferent.

It might take 2 years or more.

I have been to more than 10 assisments and 8 off them said this accident didn't effect me. after 1year of the accident I should be ok. It's very stressful to be honest but finally I'm done.

I'm very sorry you have to go through this, my advice to you is be patient and it will come through at the end.

Good luck with yours.

My case took 7 years but then settled out of court. They will drag it on as long as possible in the hope you will give up. They will also try to settle out of court as its a cheaper option for them to avoid all the fees involved with going to court. It is very stressful so you need to have a good lawyer with experience. Your recovery is important though so make your health your priority. Let your lawyer do their thing with the case, that's what they are paid for. Good luck with it all!

Crikey that’s a long time 🙈 although the accident has taken over my life and I constantly think about it it’s worse when I have appointments as I have to actually go back through it all every time I do have really good solicitors and a brilliant case worker so fingers crossed they can get me to the end Thanku for ur message

My original lawyer was useless so I ended up changing lawyers. They then settled everything. So it really shouldn't have taken that long. It sounds like you are well supported so that's great. Good luck with it all.

It is an awful experience, and it makes me so upset and angry as it shouldn’t be like this, especially as the injured party (ie most of us!), end up suffering the most in this process. I could only cope with it for 2 years, then had to stop the process due to the overwhelming negative impact on my mental health (further complicated by family bereavement and Covid-19). I instructed my solicitor to settle early. I accept that this was a much lower amount, but I had to balance that out with how much I “valued” my mental health. For me, I did not think it would have been to have pursued a higher payment if the process of multiple conflicting assessments and an adversarial court led to me breaking down even more in terms of anxiety and depression.

I’m not saying opting out like I have done is the “right” response, as it is so individual. But I have no regrets, just a huge sense of relief about not having to continue with such a psychologically distressing process for years.

I've been through it 3x and on average, depending on ur injuries and treatment, lawsuits take up to 5 to 6 years.Really depends on severity of ur injuries, having surgeries, physical therapy, figuring out what u will need help with or accomidations in ur life,ex.handicap ramp, wheelchairs, upgrades to home and etc.Best advice...make sure u get ALL u need within that time,as sometimes after u r paid off it all ends, depending on lawsuit stipulations.
