Solicitors specializing in brain injury

Hi, I am looking to select a solicitor to deal with the affairs of my stepson who was in an accident in january. I'm mainly looking for guidance on deputyship and appropriate vehicles for the management of his finances moving forward. I have looked at the Headway list and the two closest are The Roland Partnership and Lanyon Bowdler, does anyone have any experience of either firm?

Hi

I’ve instructed Irwin Mitchell and they have been really good so far as my husband was knocked off his pedal bike in a hit and run . Luckily we got the registration number of the car concerned and the incident is caught on footage . I would give both the firms a call to see if they can assist

All I would say is go for a medium sized firm. They need to have a certain amount of clout which little ones don’t but large ones will treat you like a number and file handlers often have more cases than they can cope with so you get lost in the mix.

Medium sized firm should be able to give you clout and attention required.

In addition, any firm that is dealing with people with head injuries on a regular basis should have a good understanding of the issues this raises and be accommodating as such.

There is quite a difference between day to day and longer term management (e.g. a trust fund). This is quite different from pursuing a claim for damages.

Whilst the two firms above could probably do the job for you it could be dealt with by a local firm and an IFA. Have a look for Solicitors whom specialise in "Court of protection". However, be careful, I came across one firm last week whom call themselves as "Legal Advisors" whom are not solicitors, not regulated but deal with "Court of Protection" they are now being investigated by Trading Standard for their claims.

If you contact the Law Society or (solicitors.lawsociety.org.uk/) and select "mental capacity) then enter your location. It will show you the firms and accreditations in your area

It only seems to let you search within 25 miles and that produces no results unfortunately

I also used Irwin Mitchell for my partner and they were great, but it took 2 and half years to deal with and I let their court of protection department be hid Deputy, the stress of everything, was too much for me.

Irwins takes the side of the insurers. If there on your side ok, but more than likely on others like Norwich Union and Lloyds Bank Insurance also AXA. To play your case Down to the lowest fees possible.

There Souless.

Potter Rees Dolan are fantastic! Based in Manchester 😉

I used Potter Rees & Dolan in Manchester when my husband had an RTA and they were really good and professional & they deal with head injuries all the time. They took all the stress away from the court case and afterwards when my husband was in the court of protection. They helped with all the benefit and pensions as well and I would highly recommend them to anybody. It does not mater where you live they will visit you at home and you can read many recommendation online.

Hi Claremont,

Many thanks for your message.

The firms you have mentioned are both listed on our directory as being able to help with finance management, so it would be well worth speaking to them. It's also very good to see the suggestions of other community members.

We always recommend that you speak to a few firms before making a decision, and make use of the free initial consultation to help ensure they can fully support you. That will hopefully help you to find a firm that fully suits your needs.

If you need support with this or any other aspect of brain injury, you can also contact our helpline on 0808 800 2244 or helpline@headway.org.uk

Best wishes,

Andrew

Hello Andrew, I found some information on the Headway website about a solicitor you recommend for making a will. The idea of contacting a solicitor seems daunting to me, it says by phone or Skype. Do you know, if I phone them, is it an officious legal firm or will the person on the phone be understanding that this will be a complicated and stressful experience, also an unfamiliar one, and I won't know the correct procedure.

Hi HungryHufflepuff,

The named contacts in our solicitors directory should have an understanding of brain injury and appreciate that this may be an unfamiliar experience, however the person specifically responsible for will writing at the firm may not. The best thing to do would be to contact the named solicitor on the directory and begin your enquiry with them.

If you are nervous you could also start by contacting our Headway helpline on 0808 800 2244 just to talk about your feelings. The helpline team will not be able to offer legal advice but can be a friendly source of support and information before you make your call to the solicitor.

I hope that helps, best wishes.

I would Recommend Gerard McDerMott QC on the plus side instead of Irwins who have far to many staff, and to many solicitors where no one has an idea what the other is doing with no personal touch in the slightest. Recommend saying my name. He’ll take you under his wing and treat you well.
