Appeal

I am in the process of Appealing against a PIP decision. They have only awarded me 4 points for mobility which meant l havent enough points to qualify. They awarded me the care part, but we need to have a car to get around, its 20 miles to hospital where i have most of my appointments, plus the upkeep of a car. My husband has to drive me as i no longer drive. They judged me as able to walk well, if with a slight gate and the use of AFO's and crutch. This was judged by watching me walk to their office, i was quite bright that day and answered as honestly as i could, maybe if it had been a bad day i wouldn't have been able to concentrate enough to answer the questions. My question is has anyone been to an appeal, how does it work, if i wasn't so upset by the lack of understanding i wouldn't bother.

Hello, I lost my mobility car through the PIP assessment, I went for the reconsideration appeal I lost that too.

I was that fed-up I didn't want to go to a tribunal, but the lady that was helping me fight my case from Muscular Dystrophy told me that I must.

It took months for me to get to that stage, I went to the tribunal and I won it....Jimmy

Hi, thank you for taking the time to reply. Glad you won your appeal. Did you have to go to the hearing and did you have to speak. It is going to be a few months till its heard, so the nerves are setting in.x

Yes I had to go, I had to do all the talking, there was the Judge, doctor and somebody from the DWP...The Judge and Doctor were asking all the questions, it took about an hour.

Were you rejected with your 'Reconsideration Appeal'?

My name is James by-the-way and I'm from Birmingham

Thank you James, will have prepare myself, they said won't be till after Christmas, and I am due to have op on my toe, so maybe I will be in a wheelchair that might help. I pride myself on looking as normal as possible and at first glance I look fit and healthy. Always have my hair and nails done. Maybe I will have to revise my look lol. I'm Margaret and I live in Penzance.

My goodness I'm terrified too. I'm in the same position just had my pip assessment and I went in the same as you the same way I try to walk today. Afos a cast on one foot due to more surgery crutches etc. The exercises I had to do were a joke. I struggle more than ever now and if I loose this ill loose my lifetime too. I hope you win your appeal you must go for it because you are entitled. Good luck. Tess
