Bronchiectasis disability ?

Morning all I had a meeting with my work yesterday about returning to work I had already seen the occ nurse from work went to the meeting to be told that bronchiectasis isn’t a disability i suffer from Athsma to and worked in a dust factory doin shifts can someone please tell me if bronchiectasis qualify under the disability act I’m confident it does thanks x

I wonder if they've understood the difference between bronchitis and bronchiectasis?

I had bronchitis often as a child and most people know all about it. I'd never heard of bronchiectasis until I joined this forum. Just a thought.

Hello no he knew the condition I went in with information leaflet and yet was told it is no classed as a disability I’m sure it is my lawyer will sort it out they were asked to make adaptations for my return to mek dust or chemicals and he said they can’t lol no surprise there also have had bad Athsma since nov and they no helped

Yeah I was thinking the same thing to be honest think they was want me to quit yesterday as I’m taking them to court but managed to keep it together work for them for 13 year n get no help or offered to work in other department it’s all noted for my lawyer

I’m glad that you have a lawyer- hopefully a good one. I have bronchiectasis and qualify for a disabled drivers badge and a PIP because of how my condition affects me. So what’s not disabled about that. I am no expert in the legal side of this but it seems that in addition to wrongly refusing to recognise your bona fide condition and make adjustments for the limitations that it puts upon you they are attempting to constructively dismiss you. Can you get letters from your GP and consultant so that you can educate these idiots.

My hospital respiratory doctor advised them to keep me away from dust mek and chemicals I took severely ill start of the year I’m getting stronger now but that yesterday has knocked me back a bit yeah I’ve got a good lawyer and health and safety have them two weeks notice to sort the mek out yet they still deny it as an issue been a tough start to the week 😓

Are you in the UK? The disablity act is available online. I will say that from my own experience in my last job it is up to the employer to decide if they consider it covered. I don't fully understand that myself. x

I’m In Glasgow have just spoken to pip there first time caller lol this Athsma and bronchiectasis has made me week all through the winter getting better or stronger now x

Yeah I’m in Glasgow I don’t get that when u have been diagnosed surely it’s a disability it’s stopping me living a normal life have had it bad for months now hospitals and doctors been employed with them 13 year and this is how I get treated

Hi, having been through something similar my understanding is that under the Equality Act or maybe its employment legislation, they have to make reasonable allowances for you if you are suffering a health condition, irrespective if it's a disability of not. Alternatively, re-deploy you, but ultimately, if they can't, I do believe they are obliged to medically retire you but cant be sure about that. Glad you have lawyer on board .

Hello Ginty yeah he claimed it wasn’t a disability and then in the same interview he admits he knows not a lot about it I told him it’s long term my lungs are sore with the Athsma too would been nice to been offered help from a company I’ve worked for 13 years they are offended I’ve got my lawyer in and health and safety he was want me to quit wasn’t going to happen

Will have a look now thanks for the advice everyone been helping me and making me not feel alone with this condition just horrible company that I will be leaving after my lawyer has finished with them

Had a look there yeah that will be the route I will go down after this issue with the lawyer is sorted I’ve applied for pip I’m on half pay now and paying private rent that totals 500 so was left with 100 and still to pay for my daily living I will get the pip application and see what I’m entitled too

Thank you Anne will have a look now yeah to do physio for first time on tue then to call my work to see him and the occ nurse I’m goin to ask her if it’s a disability because according to the British lung foundation I have and my Athsma is defo a disability yet zero compassion for me was want me to quit no an option retire or fire then it’s to the lawyer x
