Advice on appeal for final warning

I have an appeal tomorrow I'm on my final warning for attendance, they no all about my condition it's not why I'm off its because I'm off! So any advice ? I need to tell them why I am appealing as they tell me I have been treated fairly, they have my letter in wrighting, but having some one coming from the top to hear my appeal I want to give them wot for....also been off for 2 wks with a fit note first day back as well, this could go very wrong. I'm not ready to claim sickness allowance but they are making feel like I'm unfit to work just cos of an attendance policy. I don't see how they can over rule what a doctor says.

Hi Nik I emphasise coz I have been there too. They don't view it as over ruling a doctor and they don't sack you on the grounds of illness. They do it on not fullfulling your work contract to be at work. Semantics maybe but that's how they get round it.

Now if you want to keep your job you assure them that you are much better and are confident that you will not be taking any more time off. Remind them you have worked for the company for ..... and have always been a good worker. Tell them you love your job and want to keep it etc. Say you have put this and that in place etc. Do not under any conditions argue or have a go at them etc.

If you are dismissed then you will have no choice but to either get a new job or claim benefits. It's a bit of a Hobsons choice I'm afraid. Good luck and let us know how you get on. x

Yep I know what you mean. What your employers are looking for is reassurance that you won't take any more time off sick (or not more than the allowed time) and that you will be in every day to do your job. They need to know you have put procedures in place ie seen your doctor and changed your meds, gone or going to counselling etc. Tell them you understand their position (they will be getting pressure from higher ups) and so on.

Creeping is not nice but is essential sometimes unfortunately. Best of luck. x

Have you spoken to ACAS? They're an organisation who give free confidential advice to people in all sorts of different situations with their employment - they are very clued up on what your rights are, as well as on how to approach appealing final warnings etc.
