Pip appeal refused

So not happy so I apply for pip 29th December 2015 was refused so took them to an appeal and waited till 11 November for a no had my diagnosis physiatrist report doctors report everything hospital letters the lot what can I do this ain't right .. all because I do my nails and hair so what that's not my head is it help a please

Hi I am sorry to hear this and I am not sure if you can take it further. What were you claiming PIP for? I do know it's based not on your illness but how it affects you. Were you claiming for lung problems as you mention a psychiatrist? x

No my life up and down its a nightmare my partner looks after me .. as I can't even leave the house on my own its a nightmare he does everything for me I can't work as my moods are very mania .. and I selfharm alot .. I even lost my son due to my mental health witch I'm currently fighting for him atm x

Hi

If you have exhausted all of the appeals process .

You will have to wait at least three months before you can apply again.

PIP is for how you are affected by you condition in respect of mobility needs and care needs, including any mental health issues.

It is always best to seek advice from the likes CAB to help in completing the form

Any test results or letters from consultants go a long way in helping validate your claim.

Don't give up take a break and prepare for your next claim.

HM Courts and Tribunal Services.

Yes I have give them all my hospital appointment doctors reports physiatrist report .. the lot and their saying I'm okay on the basis my hair look nice ?? my partner cares for me day in day out in have bad anxiety panic attacks and I do not leave the house some days to the point he baths me .. :( x I just can't cope to the point I hurt myself today I lost my son cos of my stupid mental illness my head I hate being like this I'm getting counselling seeing my doctor alot it's a nightmare not just for me for my partner .. as he never knows how I gonna be don't get me wrong I have good days but life efforts me badly xx

This site is for those with a lung problem. If you have other health issues then try the drop down box above (My Communities) where you will find you can 'Browse Communities' to choose one which may be more helpful for your particular health needs.

As others have said it looks like you can not appeal any further. However after 3 months you can apply again.

Don't know what help you had to complete forms but suggest you seek assistance from CAB. Their web site information about how to complete forms and prepare for assessment is also VERY helpful.

Having said all that you are not on the best part of healthunlocked for you. This site is for those with lung / breathing problems. Suggest you search on healthunlocked site for a community that best serves your health needs.

You can actually appeal to the Higher Tribunal, as can the DWP. However, that can take almost a year.

Hi Rachel. As far as I recall, the time limit was 28 days from the date of receipt of decision. An alternative, if your condition has become worse of different from the initial application, would be to make a new application. This would be significantly shorter than a one year wait for the Higther Tier Tribunal. Also, before making a decision, you should check the current legislation as it may have since been ammended or changed. For your information: I am medically retired on ESA. Prior to this, I was a Manager with the DWP and also a qualified Barrister. Ian

I Apply on the basis of bin polar but .. 6 months in to my claim I got diagnosis with eupd so I think the reasoning is because they was no going on the new diagnosis could that be the reason maybe ..

Could be, Rachel. The Tribunal can only deal with facts and conditions that were recorded on the date the DWP made their decision. Nothing that happens afterwards can be considered.

Good idea and, you're welcome. What many people don't realise is the "Decision Maker" at DWP is not an expert or professional . . generally some clerical worker who applied for the job. All they effectively do is tick boxes . . on one side they have the Regs for that benefit and the other your application . . they just tick the "evidence" off. Consequently, it is very important to have the forms completed properly. Many appeals are made with information that can't even be considered as it has no relation to what they are checking.

These people don't understand that your hair and nails make you feel special, and feel good they should not be penalising you for wanting and looking good,,,even when you are so unwell,,,,keep fighting it you can,,,don't let them get you down,,,ttfn from Karen.

It's so hard as it's like you have to look rough .. to get the help I might look strong on the outside .. but that's just a mask x they said in the decision we can see u have mental health problems but I'm not entitled :/ I don't get it x

Looks like your spell check is substiting "physiatrist" --- a specialist in rehabilitation and physical medicine-- for "psychiatrist" -- a doctor for the psyche, or mind. Note that "psychiatrist" starts with the letters PS.
