Thanks Offcut. It is interesting to see that Interstitial Lung Disease is not on their list. When I see ATOS I will have to refer to my lung disease by its other name Pulmonary Fibrosis caused by Rheumatoid Arthritis. You have to be so careful with terminology.

I found by accident on the DWP web site that if you had COPD you would be awarded indefinite but as I have level 4 COPD I was turned down for DLA so work that out.

It depends on who made the decision those employed by the dwp or for the dwp?
Hi Offcut I phoned them July they told me they had contacted my GP for further information I phoned them again to tell them my condition was worse and they told me a decision had been made the week before I finally got the letter from them 16th September with all the medical evidence they had based there decision on and all I got was what I had sent them.
I don't think they even contacted my GP nor did they contact any Doctor working for DWP I think its right and left hand syndrome not sure if you can claim DLA for that lol
They will make the decision from the time that you have made your claim if your condition is different (better or worse) at a later date that will only be looked into on your next review. My consultants letter was dated and stated about my conditions before my claim so this was a valid addition to my appeal.
As for the contact with your GP I am sure you have the right to know from your practice if information was sent to the DWP. If they state they had no contact, then the DWP have not applied due diligence for the facts to your case. but as I said earlier the information should be from when you applied. Anything after that date will not be taken into account.

Not one of those things written in stone I just think they make it up as they go along. I did read with interest the level's of COPD which these people have access to and clearly shows level 4 is severe.
The difficulty is that we are all so different. Some really struggle to breathe/move around at quite an early stage whilst others classed as severe can continue to work, as I did for years and as Puff the magic dragon does. Doesn't make it easy, does it?
I'm appealing as we speak I have sent them the last test from my GP but I can't believe the difference between level 3 and 4 it has really knocked me for 6, I got the flu a few weeks ago.
