When to take maternity leave

I’m due 20 May, and i want to take two weeks holiday at the beginning of May (37 & 38 weeks) and then start my maternity leave on 16th May (39 weeks).

I only get statutory maternity pay which is why i want to leave it as late as possible.

However I’m concerned that if i book those 2 holiday weeks off but the baby comes early, do I legally get my holiday back? My work is stingy is all and i know if they can get away with it they won’t give it to me back.

Hi. If your baby comes early you immediately start your maternity leave and so legally you wouldn’t have used your holiday entitlement which should automatically mean that you carry that over to the end of your maternity leave and take it before coming back. It’s worth checking your maternity policy though. Best of luck x

Yes. If baby comes early maternity leave starts the day after birth and legally you get your holiday back. If your employer goes against this (if they did it would be considered discrimination against you) then contact ACAS for advice and support x
