Court of protection advice.

Has anybody been through court of protection? How long does it take?

I used it in 2012, not exactly sure what your question is though. I have all the paperwork and emails in a file.

From memory though, I had to apply first with a form setting out what my case was before it was accepted and then I had to fill a formal application form in.

I had a solicitor under legal aid which may not be available now.

I then had to get a mental capacity assessment done for my son to show he could not understand the case himself so he was given an advocate himself.

I wont lie, the formalities were a right drag, but in the end it came down to a very simple court case and amicable ruling.

Not sure what you are asking but our experience may help.

Please be very careful of COP and social workers. They are not always reliable.

Do you have a court case looming? What type (don't need to be too specific)

We used a solicitor to fill out forms for Power of Attorney to file at COP.

Our son can speak and understand very basics so the solicitor asked him who he would like to help manage his affairs. Son chose me. My adult daughter is deputy.

Solicitor filed all papers.

I have POA for Health & Welfare and Finances and Affairs.

Think process cost approx. £250 for each

Did you apply for a Personal Welfare deputyship?

I wonder how you got on as my father and I are hoping to make an application and any information on the process would be useful to know.

My brother lacks capacity so we would have to apply for a deputyship instead of a POA.
