I have had an assessment by Atos health and deemed fit for a work related activity group, yet been given a 3yr prognosis can they do this

I have reynauds in my hands and have had three major flares in the last year.Hopefully you took your medical notes to the assessment.I have a friend who is extremely disabled and I mean extremely and she is being assessed to work.Try and get some legal asdvice.

I am in the work related activity group for a similar amount of time but I didn't have an assessment! It's not as scary as it sounds, work means voluntary something and no set number of hours! If I were you I'd go to my local CAB taking all my paperwork and they'll be able to advise you what you could do. Hope I've helped and good luckX

3 words. Appeal appeal appeal. Many decisions by ATOS are being over turned and ATOS want out of the contract.

I was put in the work programme too even though they said I would never be able to return to work I appealed bit still waiting for the outcome

Hello, please try and appeal if you can. If you are placed in the WRAG group, and your ESA is contribution based not income related then your payments will stop after 12 months from the date of your first payment. Many people seem unaware of this. However, this is not the case if you are placed in the support group, if this is so, your ESA continues whether you are entitled to it as either income related or contribution based. I hope this makes sense?

I agree with bonnie, appeal! I too was placed in the wrag and I sought out advice from the cab, we appealed and went to a tribunal where it was over turned and I was placed in the support group for a minimum of 12 months. I really feel for you and think it's absolutely disgusting. I have sle, sjgorhens, raynauds and chronic pain syndrome and their are days where I can't even get out of bed I feel so ill. Give it a go and good luck. X

I had my Incapacity stopped and was told if I supplied medical notes from my doctor I would get paid until the appeal, I did supply medical notes for 2 months but got nothing so had to sign on JSA and told what I had to look for work, and then put on a computer course but I must say the lady who deals with the people with disability's was very good and made it as easy as she possibly could for me to ease the stress but it was still very stressful and my illness got worse. I had my appeal Friday and it was judged in my favour so you must appeal. We really shouldn't have to go through this. I totally broke down at my appeal and it made me fell very ill and still not got over it yet, but you are assessed by independent body to ATOS, but you mustn't hold back on how your illness effects you.
