Hi could do with some help failed ESA medical and recommendation do I take it further ? now put on JSA but still have sick notes

It is definitely worth appealing.Many people get the decision changed upon appeal.

If you need help with the appeal, it may be worth contacting your local Citizen's Advice Bureau.

If your GP believes you're unfit to work then I would definitely challenge the decision. As Paul says, many decisions are changed when challenged. However, if you want to be sure of the best outcome try to obtain an Occupational Therapy Report. This could be commissioned via your Rheumatologist, free via NHS, or you could commission one privately. Also have a look around benefitsandwork.co.uk/ Good luck Dawn x

It's definitely worth going to your local CAB if you want to appeal your ESA. They will give lots of help. Sorry it's needed, did you have a medical assessment?. Good Luck. X

Hi, I helped someone to appeal recently and the decision was overturned, the approach I took was to look at the reasons given for failing to meet the criteria, if not included in your decision paperwork ask for it to be sent to you. I then explained in detail, point by point how their assessment had 'overlooked' elements of the applicants illness/disability that meant they met the criteria. A logical and methodical approach is best, it is also good to remember to focus not only on what is wrong with you, but importantly to note how this affects you in your day to day life i.e. fatigue results in limited activity that requires a rest of an hour of two following activity.

Sometimes the DWP need to have things in bullet point and detailed explanations to understand how illnesses affect people.
