Disablity Act 2020 updated version of 2010 - try reading the section that say employment mr manager heres the link

"Redundancy and retirement

You can’t be chosen for redundancy just because you’re disabled. The selection process for redundancy must be fair and balanced for all employees.

Your employer cannot force you to retire if you become disabled.

Employment

It’s against the law for employers to discriminate against you because of a disability. The Equality Act 2010 protects you and covers areas including:

application forms

interview arrangements

aptitude or proficiency tests

job offers

terms of employment, including pay

promotion, transfer and training opportunities

dismissal or redundancy

discipline and grievances"

In short after my birthday i am getting dismissed becasue my mum died after my manager told me in march that my perforance was improving then dropped back down after shed died in april and i have been struggling all year to improve it for obvious reasons but like the company and department i work for care because of the current finance cliamate we are in

Hi Bex.It's was about time the disability act came to force. But it seems there's still quite a lot of wriggle room for employers, so long as they mention other reasons.

I know my cas was over 20 years ago but it was a case of we haven't anything for you. At the time my job included office work plus manual work in a 50 50 capacity.

At the time of my rta my job was to move to a solely office based role. Even though my recovery was estimated to be at least another year plus I was finish, no redundancy just one month's notice. At the time I didn't comprehend what was happening.

It was also annoying looking back because they had to employ three people to cover my job role on full time contracts.

Looking at the disability laws they are great as in that if in my case my disability was cited as the reason for my employment finishing today it would be deemed illegal.

Having said that if an employer can pin it on outside forces eg . economy then the can still get away with it. Plus anyone becoming disabled whilst in employment will probably not be in the frame of mind to fight this, being to busy trying to recover.

Sorry for long post, think it hit a nerve.

its fine i kept it short and sweet because i make long ramlbing posts that make no sense half no time this is why i have been quiet on this forum i could go into massive details but i dont becasuse i will got off topic and start swearing

I know how you feel. I generally gonoff topic so have to read what I've written to keep on track. I'm worse in person, my kids say I talk to much to make up for when I could talk properly. Then again not sure I talk properly know.

Everyone needs a good swear now and then.

There are lawyers who know if what they are doing is ok. Usually you can get a free consultation- write the facts as bullets- they can read fast . Find one who deals with injury and employment ad the usually get bi.

Not what you asked but it is what I would do. I trust no hr department.

yep i have internal contacts away from my rep and our department that can deflect this with out his knowlesge as he is a rep as well so he will only talk in mans term to my rep and think i have nooooooo idea what he is thinking I spoke to a lawer on how to deal with my uncle bc he wasnt very nice towards me as i wasnt doing as he asked and ive had to mention things to my aunty in derby about the mess her younger son is in dubia so he has messaged me with call me now and my data is off so i can read it but im not calling them yet bc im in the mood to cause war as im a vexxed women

I was retired in 2011 on the grounds of ill health (I wasanursespecialist). Occupational Health stated that I was not fit to work in any role. At the time i couldn't imagine any options that I could fill, and for the most part would still agree. When the pandemic was in full flow, although I could demonstrate competence to carry out limited practice, the hoops to jump through were insurmountable.

the issue is me and him have very close personalities only i have that and more so we can argue and all of bristol can hear us shouting and swearing at each other he didnt like me working from home as he hacked my friends broadbrand and used it to agaist me while i was fighting for pip and walking to access to work/ redelopy during locked down and i got recalled bk into the office as he didnt believe the words i was saying so it was his manager who hired me to put me on a projected to build out win10 laptops for roll out and he was still critizing me and his then manager who is no longer his manager has sooooo many stern conversates with him it was hard not to ear wig when he was sitting in my line of fire of my ears and the office is pratically silent bc not that many collueages were bk in
