help direct payments from social or care home

hi

I hope someone can help me my husband has cognition problems he had hypoxic brain injury nearly 2years ago he has recovered quite well but left with cognition problems like short term memory wondring off etc

last Sunday he opened the front door and just went off the police found him and they got the social involved

my husband'social worker rang me saying I can't care for him at home as I work full time he needs to go into 24hr care I don't want him to go into a care home as his doing really well and I know care homes where your sitting infant of a TV all day I don't want that for him

can they force him to go into a care home he has no capacity he is on a spouse visa in this country so he is not entitled to any sort of benefits I'm providing for him

the whole situation is really stressing me out the social worker has said his not entitled to welfare benefits but is entitled to social

can I ask for sit in services for him from agencies while I'm at work I have heard about direct payments that the social give u is anyone here getting that and how does it work

Directs payments will work I'd entitled and you get enough hours.

I have capacity but also bad short term memory and prone to wandering off/forgetting where I'm going.

I get direct payments which allows my wife to work/get a break. The problem is funding as my hours have constantly been cut.

Depending where you live also affects how it is managed. Some areas sort out the complete running of it while others only handle wage slips.

It can be a minefield finding the right person or people but once up and running it can be a god send.

I to was offered a place in a home. Initially respite with the prospect of permanent. It would have been hell. At the time I was in my mid 40's and the next youngest person there was in their late 70's.

it's good you have a social worker, hopefully they know about bi. Keep at them it will be worth it.

thank you for ur reply yes I will ask the social worker for direct payments for him I know if he goes in a care home he will jus go back to square one

you know when your saying direct payment is it some sort of budget that the council give u I have rang a couple of agencies who do do sit in services I only need someone with him during the day time as my husband does need help

as far as I'm concerned you can use an agency and the payment directly goes to them or is it you have to deal with it yourself like tax or payslips I'm sorry for all the questions I'm jus confused in how it works and I just want the best for my husband

Direct payments is fairly easyonce set up.Finding how it runs depends on the area you live . At best its all handled for you at worse a company will handle payroll for you and send you the wage slips letting you know how much to pay in wages tax etc.

Only main stipualation is having a seperate bank account for direct payments. Also you have to have a specific insurance but you are given an amount each month to pay for this, its basically liability insurance.

It gives you freedom to say when you need thev care and who you employ.

For a job I used to monitor Direct Payment spending, ask any questions you have, I will help as best I can, and I have friends that still work there if I can't.

thank you so much for your reply I have one question when you use an agency for the person who is getting direct payments eg sitting services do u still have to do the insurance and register with the hmrc and give out payslips or does the agency do all that and pay there staff

You can use the direct payment to pay an agency, but over time your payment will go further if you employ directly, there would be an agency that your council will advise you on that will help/deal with the salary and insurance side of things.
