Could I please ask for advise on assesment of care by social services. I am mother to George who is 28, 4 years ago he suffered a hypoxic brain injury, he is now unable to walk and hoisted to transfer. He has use of only one hand, left one, and mentally he is just a little forgetful with short term memory loss. He is moving into a flat so he can gain independent living, as currently he is in a nursing home. His social worker has recently been changed, and hasn't met George in person. I was dissapointed that after doing assesment she is saying he needs 5 hours care a day. Surely this isnt right as he can not do anything for himself!! Please could anyone help me, as I fear I am going to be left with caring for him on my own. Thanks

I'm not sure what services you have in your region of the UK. Where I am (Wales) there is a communities solicitor funded by the Welsh government. Their role is to challenge your local authorities to ensure the correct care is provided. You may want to contact the CAB or other agency to see if you have a communities solicitor that can act on your behalf. There is always your MP but it would be an idea to try other avenues first. Complain to your local authority, his needs clearly not assessed correctly, part of the assessment based on the MCA as well, they have a duty to promote an advocate which is highlighted in the Care Act. I would also request the amount of input residential do at the moment, morning, day night. Tioleting needs, getting dress/washing, meals, hows his sleep is,, managing medication, accessing the community, seeking medical attention, /appointments, keeping his environment clean absolutely everything. All the input residential do gather evidence to challenge, do not sign or get anyone to sign such a plan until you know hes in right accomodation and right support in place.

I would ask for a copy of the assessment that they are basing the care plan on. Without that it is very hard to challenge what they have decided. It doesn't stop you challenging the care needs if you don't have it, it just makes it easier if you know what they are working from. Good luck.

Research local care services properly. Contact your local social services department to start the formal complaints process. You might have to take it to tribunal. Also ring the CQC for some more helpful advice and tips as well on how to proceed further. They can advise you further.

Be strong, be assertive. Make notes too. If possible get a paper copy of your care plan assessment. This is very serious and needs to be resolved. Ask to meet pronto. Why does she think that? Keep a file of supporting evidence to prove your case. He is being failed completely here by the social services team. Print out emails etc in addition.

Hi I'm glad that George is moving on and my advice regarding his care hours are to echo others. Ask for a copy of the assessment which has been completed and also for the evidence which has been used to complete that assessment - so reports etc from the nursing home, OT's, physio etc. Sometimes they use just the individuals report which if they have memory problems or just esteem issues they down play their own needs.

I also though have a question, as the parent of a 30 year old who had an hypoxic injury 4 years ago and has a residential placement he hates, who helped with finding a property, and benefits etc?
