I'm new here, need advice on ESA tribunal.

went for capability for work assessment and received no points ? been in receipt of disability for past two years, it seems all my health problems are manageable ?, I contracted hep c 30 years ago, underwent treatment in 2007, left me with hypothyroidism no problems till 2011, meds stopped working since then I have developed;

Chronic fatigue syndrome, chronic diverticulitis, chronic depression, fatty liver , my bloods are always messed up always showing high white blood cells.

I sleep most days, always in pain and bloated abdomen already had one internal bleed, I can't describe the pain but it was much worse than childbirth, it takes me all day to empty my bowels as I,m either constipated or have diarrhoea, I also have leakage. My liver dose give me pain under my rib cadge and I sweat so much.

Any help with the benefit or tribunal system would be much appreciated. thanks guy's x

You need to get a disability specialist to help. CItizens advice or Age UK if you are over 50. Disability rights service pay a fee and get their advice. You need to look at the points you need to achieve . You must have asked for statemenet of reasons . Get together all your medical evidence. You are preparing for a test.

Reports from specialists. Support letters from family friends. Tell your GP what is going on. GP do not seem to realise you need different letters for benefits so you need to tell him why you need it. You need evidence of cmht involvement for depression. Also need referral to incontinence nurse. Keep a diary? Etc

Look at citizens advice website the support documents there are invaluable.

Have you claimed jsa to support you. Where you in the WRAG or support group before.

Basically you need a professional to support you through the tribunal. Be prepared to answer the tribunals questions. Do not go alone. Most importantly get evidence to support you.

Hy there thankyou for your reply. No I was not in any work related group while on ESA, I am claiming JSA at the moment, I have received my Tribunal letter and am awaiting my appointment with the citizen advice specialist as he has gone on holiday till next week. The problems I am having is with my GP, I have had to change surgery's as it is impossible to get an appointment and I never got to see the same GP twice, so explaining the different letters and why I need them is impossible. The stress of this has enlarged my stomach to an epic painful mess.

So you were in support group basically left alone now after medical they think you can work. What support from your job coach or whatever they are called. Have you got written on your jsa job seekers agreement limitations because of your health because you should.

The job centre refused to put any limitations down so I covered it with a limitation for work off a GP. I have just put in a sick note to re-claim ESA while awaiting tribunal but this will be at the lower rate.

The benefits and work. Co.uk organisation specialise in helping people through the health related benefits system. It might be worth you visiting their Web site. Some information is free but you have to join to get the most help. The membership fees are quite modest.

So do you.mean youve lost all your sick pay...if so appeal apparently tje gov bodies /asessors turn down a high percentage of people in the hope we dont appeal then thats loads off their books.

I concentrated on the form not on  the actual symptoms but  how that these things affected my ability to work e.g.excuse me being basic but diarrhoea means i need instance continuous acess to a toilet which is close by...not i feel bad because my stomach hurts beacause i have to go to the toilet a lot.another example ...i need frequent acess to food  and water...little and often to keep my symptoms at bay...not i feel worse if i dont eat.

My standard reply to all the boxes is varies...due to pain extreme fatigue i am unable to do blah...alsi my fatigue is cummulative so any activity is made worse by doing something else.lets put it this way i wouldnt employ me..

Dont think id get much done between sitting  on loo eating drinking oh thats without mentioning the concentration problems  from the fatigue alsi transposing numbers i right down is not very helpful...so the list goes on...its just making sure all these things are on the form in a way that shows you couldnt sustain a working day but definately appeal.good luck.cazer.

P.s on a different note do you have cirrhosis...if your tummy is that bloated soumds like you vould have fluid  build up ! Do u see a liver specialist? Cazer.

It might be that I do, the last scan only showed fatty liver but my health has declined a lot since this started. No specialist as yet, my GP was sorting me one out but everything has got lost in, sick notes. doctors cover letters and not been able to get appointments, just changed my doctors , so hoping I can find a GP that I can see constantly. My diverticular disease also swells my stomach and is triggered by stress as is my thyroid.

Hi I am going through the same thing. Look on the fightback4justice website they have lots of advice and are representing me at tribunal. Good luck
