Physio tired bronchiectasis Athsma
I am sorry to hear that you are having problems with work. I hope when you see them they help you find the right decision in this horrible situation that you are faced with.
Already had a meeting with them before my first physio session I’ve got lawyer involved as I was using a chemical that they should have gave me a mask for health and safety also went in to give them 2 weeks to sort it out last interview he claimed it wasn’t a disability but knows the Athsma is couldn’t make it up it’s worse than the Athsma got scarring and left lung is always sore feel helpless x
As I said before, he needs educating and if your lawyer is good he is digging a hole for himself with intransigence which is fuelled by ignorance. Is your consultant involved in this? A report from them should put an end to this fiasco once and for all.
You have 2 issues against the company here. Firstly The use of the chemical was dangerous for all employees, not just those with chest issues.
Secondly bronchiectasis is a disability. Also it is progressive and so the level of disability increases with the progression of the disease.
I am not quite sure what your lawyer has been up to but he should have pinned their ears to the wall on both counts.
What do the other employees think of your employers abrogating their duty of care for their welfare by using the chemical?
They are to scared to stand up to this man his nickname is the hatchet man cause he cuts jobs all the time he bought shares into my company three year ago and it’s been nothing but trouble my gaffer retired who fought my corner as his daughter had Athsma I’ve just been diagnosed bronchiectasis on jan yet still get warning letters and money reduced yet he knows I’m really ill to meet him and work nurse next time so goin to ask her if it’s a disability she works for them tho so if she says no il advise them to check the British lung foundation been draned and skint from last month for been unfit to walk let alone work so unfair I’ve grafted all my days x
I don’t understand why people who have no knowledge of the condition are being allowed to rule on whether bronchiectasis is a disability. It is the effect of the bronchiectasis, combined in your case with your long standing asthma which results in the disability NOT the label of bronchiectasis itself. This man is breaking the law. Please get the help of your consultant and GP.
Yeah it’s all cowboy stuff this man thinks he’s above the law he’s took money off me while I’ve been off sick said they over paid me then took the lot off my last half pay when i wasn’t aware of it he doesn’t care bowt this he reckons I could still manage a shift if I could I would I need the cash more than ever but can’t have the strength to do my job was heavy going in a factory
Thanks camilla yeah it’s been a tough six months from Oct was really bad with Athsma then jan diagnosed with bronchiectasis yet still even after hospital letter and gp letter asking them to make adaptations to my work fell on deaf ears so my only option be fire me or retire me up to u won’t look good for your company when we go to court
Hi if you are in the UK then your employer has the legal duty under the Health and Safety Act at Work to make some reasonable adjustments for you. They have sent you to occupational health, but the bad news is any adjustments are subject to 'business needs'. They should still make some RA for you though otherwise they are breaking the law and if they don't you can take them to Tribunal. RA's can be extra sick leave, more breaks, even a different job if available. I hope your lawyer is reminding them of the law.
You should also have the option of maybe working less hours if you can afford it. You might be able to get PIP as this is based not on your illness but how it affects you. This would make up any shortfall.
I wish you luck. x
Hello hypercat no they said they could keep me away from mek but the factory isn’t dusty looked at him reminded him I’ve been here 13 years to your 3 might no be dusty in your office upstairs but in the factory floor there is a lot of dust chemicals and adhesive that blocks your nose which I’m relying on more so now to ease the pain on my left lung I’m taking the booklets in to them it says employee should also look up the diagnosis so they know what to expect yet he admits he knows nothing about it although it’s no a disability try telling that to anyone else I’m ready to go the full way to court x
Well I think you have a good case for medical retirement. You would get more money and benefits if you took this route. A lot depends on your age though and if you want/need to be able to work again at a different job in the future. x
He’s no happy I’ve got my lawyer involved and he got the health and safety to confirm that no ppe was issued to do the job stuff is bad comes in a barrell with skull n bones sign toxic yet I had to ask for my own mask this jan to try and stop my Athsma have a letter saying here’s masks u asked for guys a Del Boy the lawyer will get tore into them just the now there taking it out on me so no adjustments and no position change or even shifts expected to be sick and be able to do early shift then night shift then backshift rotation body can’t cope walking a couple of stairs he’s deluded x
I’m 38 and have worked for them for 13 years never had a problem then took a bad athsma attack work never offered any help advised me if I kept smoking and had another Athsma attack would be discipline then got told to brush dust down last day before Xmas shut down with my manager swallowed a load of dust and was in hospital jan that’s when X-ray and ct scan in another hospital confirmed the bronchiectasis should not been told to brush down racks full of dust in the first place also the mek situation they provide masks for the same stuff every where else in the factory apart from my area it’s no right x
I think you should have some rights under disability law, you’ve got a lawyer,so that’s good. When you get used to bringing up the mucus, things might get a tiny bit easier . Since I became involved with the respiratory team,I can get rid of the mucus easier.
They explained to me that if the mucus sits in your respiratory system,it will breed bugs and infection starts. Have you contacted the citizens advice .??they were very helpful to me. If you want to claim benefits in the future, they will help you fill in the forms.
I feel for you having to fight for an intransigent employer,it’s bad enough having this sort of illness. I count my blessings that NSIP didn’t get too bad until after I retired,so at least I haven’t got a job to think about.
I was working on a temporary basis until last Autumn.Ring. Citizens advice on the National. Line. It takes ages to get through, but when you do,they are helpful and understanding.hope this helps
I don’t understand why a physio would tell you to be sick. Being sick is nothing to do with efficient lung clearance.
Maldybhoy you really need letters from your bronchiectasis consultant - they really can’t argue with evidence from a respiratory expert.
Good luck
Love cx
