l have several health conditions and get the lower rate DLA but need to reapply for the higher rate. So is there anyone who could help me with some advice.
I scored zero points at my ESA medica... - Lung Conditions C...
I scored zero points at my ESA medical and went for a mandatory consideration and so also turned down for that now l have to go to tribunal.
I do not understand how they cannot give you points when you must have points as you are DLA/pip mobility which means on that you have scored a minimum of 8 points but not higher than 11?
Have you had your full report back explaining why you have not got any points?
The ESA assessment is different from the PIP assessment, they mean completely different things and are completely different benefits, so because of this the points for one do not relate or to cross over to the other. To go to tribunal you really need specialist advice in my opinion from a benefits advisor at CAB or the like.
Thank you Suzey l am going to citizens advice to ask for help.
Agree with suzey you defo need expert advice CAB, Welfare Rights or DIAL. Under the old DLA if you applied for a higher rate than you were already getting (think they call it supersession) you needed to be aware your benefit could be increased but it you could also lose it. Think if you applied now it would be for the new PIP - I would urge you to get expert advice, they will assess and will have a good idea the best action to take and will help you do it, which takes a lot of the pressure off. They would also advise on ESA
Good luck.

I was turned down for DLA and ESA I put on the form I was severe COPD level 4 and if you look on the web site that they can use when making a decision it clearly says '' if awarded award indefinitely ''. but because I did not go in to detail and explain I was turned down get CAB to fill in your forms
