not been to a tribunal but have attended, with hubby, 3 Industrial Disease medicals. The first time we didn't know what to expect, the second and third time I was prepared, I took letters from the hospital, GP, all the repeat prescriptions, the latest spirometry results, we also accurately measured how far he could walk as if you guess you always think it is further. Basically every bit of evidence you can gather will help. Good luck, let us know how you get on.
These people haven't got a clue. they're not or, never have been ill, otherwise they would understand the problems people have. All I can say is go in prepared, write down everything regarding your health, no matter what, it's easy to forget things when you feel nervous, and take all your medical notes with you. Good luck.
Do not go dressed to impress or if possible do not wear shoes that have laces or lots of buckles. Do not be afraid to question them when asked a question. Questions like "you managed to get here" (looking at mobility) answer with the obvious "I had to come but it was not pain free or easy to do, As I have to for hospital and doctors Appointments "
I was told that any evidence later than your claim date does not count as new evidence. But nothing to lose by stating this confirms what was said earlier.
Exceptional circumstances (Non-functional descriptors)
There are a small number of cases where the claimant could carry out all the activities in
the assessment, but would still qualify for Employment and Support Allowance, either
limited capability for work if either of the following criteria apply or limited capability for
work related activity if only the second one applies.
The circumstances when this would apply are:
good advice ,be well,bernice
go to the tribunral tell the truth and be yourself that's all you can do
I was advised by social worker many moons ago to tell them what you are like on your worst days,... because when filling in forms if you are feeling a bit better on that day..... you are liable to put just how you are are feeling on that day.... whereas the rest of the week of month you may feel like rubbish, in the end she asked me, almost begged me to wait for her to come and fill in the form so I didnt get turned down,.. I know your are not asking about the forms but if you just imagine what you are like on your very worst days, just relate that to them that cos it is true, hope this is helpful to you, and good luck mommalou, you fight for your rights, we have to, Joan x
Don't use any words with 3 syllables or more they don't understand I went to a tribunal this year and the DR did not understand radio frequency { it is where a nerve is burnt and stops pain down the leg } you will feel intimidated and made to feel like a scrounger and like Offcut says don't go dressed up because they think if you can comb your hair you can work on a till in Asda. Good luck I do hope all goes well for you
Hi i am wondering if anyone can give me some advice, I have uncontrolled asthma, arthritis, fibromyalgia, hypermobility severe long term depression and the start of emphysema. I am a full time carer for my husband who has a serious heart condition, i get carers allowance. I am finding it really difficult to manage now as i am always out of breath always so tired mentally and physically. Should i give up my carers allowance? It would be very difficult to manage without it but i am struggling to care for myself some days. I apologise in advance for any spelling and punctuation errors! lol
