Stupid Benefits people...

Back in 2005 I got all the benefits Iwas and still am entitled to (with the help of the CAB) which included Lower Rate Mobility. Getting diagnosed with COPD and suffering problems with breathing and walking I applied for the higher rate and got a letter back yesterday (Wednesday) removing my Mobility Benefit altogether, just when I need it the most.

Sadly the CAB are no longer contracted to deal with Benefit cases (believe me they were absolutely brilliant), so I am now not sure what to do. I will call the gentleman that did get the benefits for me and see what he has to say, but other than that I am worried now that if I pursue this they will take the rest of my benefits off me. Any suggestions and advice would be greatly appreciated especially if you have been in the same predicament and won your case.

Most CAB Staff Have Abandoned Ship ... As They Don't Like What Is Going On With CAB Funding .... Here Have A Look At This They Started Own Advice Group

A Welfare Rights Advisor, employed by your local council should be able to help you. They offer independent advice on benefits and help with forms and so on. If you live in UK you'll probably find advisors through a local 'One Stop' council office.

Have u tried age concern,there brilliant,theyv gotten my dla twice now,they will even Come to ur home if u can't get out

Hi, I joined Benefits and work, It is about £19 a year and they give expert advice. They also advise and help with how to appeal decisions.

Many years ago, I was turned down, and went to "Age Concern" who filled in the application form for me. I was awarded the higher amount after my GP confirmed that I had copd. Hope this helps. I was so grateful for the help I was given. Best of luck.

you say middle rate mobility. Do you mean middle rate care allowance? Mobility is for help with getting around and only has lower rate and higher rate. Care has low, middle, and high. if you are talking about high rate care unless you are about bed ridden, with care day and night, you would be unlikely to get that. DLA now seek clarification of your condition from your specialists. Quite rightly if people put in a claim for DLA and the person does not have a specialist they are not likely to get an award. You will need an assessment from your chest specialist, or oxygen nurse, respiratory nurse. In fact DLA are more interested in the specialist reports than the doctor. They will also need to know what medication you are on, and proof of it. They know what medication you will be on for your stated condition.You can appeal although your money will not be reinstated until after you have won the appeal when it will be backdated.

Thank you everyone for all your comments - you have all given me ways to go about getting this sorted and I will have a looksee at them all and will keep you all informed of my progress. It is absolutely rediculous how they have 'behaved'. To say I am able to walk 40 metres especially when I originally got the low rate mobilty for not being able to walk less than that back in 2005. Back in 2006 I had a severe Asthma attack that put me in a coma for eight days and now their impression is now I have been diagnosed with COPD I can walk without any difficulty - for God's sake my drive is less than 10 metres and walking that I have breathing problems and panic attacks. Sadly this country has gone to the dogs...

I have justspoken to the Benefits Agency and got across much clearer my condition which the lady took on board. She invited me to request that they review their decision and in particular the fact that I have not only severe Asthma problems, but also now diagnosed with COPD and this is what I have done - asked them to have another look at my application and should this not be successful I will request the documentation to go to an Appeal Hearing. I am also going to (when I see my GP on Friday) ask him to write a letter stating his recent diagnosis and the condition of my health in general so that I have that to hand should I need it.

I used to work for the CAB. I even used to update their files on the various issues. There were a huge amount of them, thankfully classified by subject. any adviser could turn to these to find what an issue meant.

I believe that Age UK now fulfils this task.
