so down just been layed off cos of sickness levels.

Went to go back to work today after being on sick for 17 days, 10 days which were spent in hospital, only to be told that they have gave me one weeks notice then i am out of a job.

I only been in the job for 9 month, but how can they do this, i was upfront with them when i started the job and told them i had moderate asthma, but this has been progressively getting worse this year and i have had 3 hospital admissions since may plus a few visits to A & E were just had nebs and released.

I am so down about this , i just dont know what to do anymore.

Sorry for the rant just need to shout and scream about it.

So sorry to hear that. I'm not an expert at all but this does sound suspicious, I would find out what your rights are as they may not have given you what you're entitled to. After 9 months I would have thought you're past any probation period and ought to have more than a week's notice, though admittedly I don't know for sure how it works with sickness.

Maybe someone else on here will be able to advise you, but I just wanted to say don't give up because it does sound to me like they haven't treated you right - I think they are supposed to make reasonable adjustments before laying you off, for a start.

I think i will be having a trip to CAB tomorrow to see were i stand, i was on a 6 month probationary period when i started job in middle december, but i had 2 day hospital admission in may with a week off and then in june i had a 5 day admission and needed a fortnight off, so because of this they extended my probationary period for a further 3 month untill 20 sept. But now because of this latest sickness they are not even going to let me see out my probationary period, they even told me my work is of a very high standard and it is just down to my sickness levels.

I thot they had to let u work til then end of ur probation period which is what there purpose is for!!!

I think they can sack you for sickness but only after reasonable measures adjustments and warnings I think. Not sure through when you are in probation period, I would contact citizens advice they are normally really good at helping with this sort of thing. Have also sent you a message message back if you want anything.

they can sack you for sickness however number of things first... firstly reasonable adjustments ie working hours, envornoments.... 2ndly check the policy first might have to have warnings first but depends on the company. though not sure over the prob thing I know cant claim unfait dismissal as you havent been working for them for longer enough

Oh thats so crap and unfair, ive been out of the ""work loop"" too long to know what they can and cant do now so dont want to say the wrong thing, but just wanted to say how sorry I was to hear that and that you are in my thoughts and I hope that you can get it sorted

ACAS may help you with some advice? I think they give advice and know the rules inside out. They have a phone helpline. See:

This is terrible hope you get some sort of comeback. I wonder how we are suppose to be able to work again if this can happen.

Hi thankyou all for the replies and kind words.

I went to see someone at CAB today, he reckons i may have a case for unfair dismissal under the disability discrimination act and he is willing to take my case on, this is if my asthma is classed as a disability. This is were the stumbling block is he said, for asthma to be classed as a disability you need to have had 6 hospital admissions lasting longer than 24 hours in a 1 year period, i have had 3 since may 5th, the last one before that was 26th sept last year, but he said hopefully it wont be much of a problem because i have also had numerous visits to A&E were i have been okay to come home after a few nebs etc.

I have to see him again next friday and let him know if i want him to take the case on. Ahhhhhhhhhhhhhh i just want to go out and work, i am getting so frustrated with all of this, he also said might be difficult to even get another job as well now because will have to say got layed off because of high sickness levels. Sorry little rant over with again.
